Hi there I signed trust deed on 28th may. Couple of creditors have written to me bout missed payments now. Do I ignore or tell them what's happening or what?
Hi notntodeedyet,
I started off by ignoring them and not answering the phone cause I was too wimpy to speak to them but now if they call me I just give them the name of my trustee and tell them to direct any questions to them - I felt better for it. I signed about three weeks before you and it's a nervy time so good luck.
Gather up the letters you are receiving and send them in to your case administrator. Maybe send them in on a weekly basis until they stop making their way through your letterbox.
Your TD company will then chase the creditors in order to stop them contacting you.
Great ok! Surprisingly I feel quite calm! Think it's because David has been so reassuring that based on my case it should be in Gazette next week I think then taking it from there. He's told me what can make a deed not be protected and none of it applies to me so pretty sure it should all be straight forward I hope. I have done everything I have been advised to do so hipefully will be ok. Thanks for advice folks x
just my opinion but I actually found that after telling companies I was going down TD route (lots of them as well!!) they were actually very good with me with some even wishing me good luck, I felt better for just being honest after dodging phone calls for months/years!!
Good luck, wish you all the best.
will tell them when they start to phone and keep the letters together and send them regularly to david. getting nervous again that the deed will not get protected knowing my luck
I know it is easy for me to say, but try not to worry notntodeedyet. The chances of it not getting protected are very slim as long as your proposals meet the criteria, which I am sure that they do.
I'm 1 year in and I still occasionally get a letter or phone call but as I did at the start I just tell them I've signed a TD (and now in a protected TD) and I haven't had any issues
It is a tense time waiting for it to become protected but I was advised the firm that a TD wouldn't be put to creditors if it didn't have a very good chance of being accepted
I'm sure everything will be fine 🙂
final payment 1st May 2015
Letters like these always cross over and rarely have any bearing on matters.
The trustee will know the criteria to have the trust deed accepted beforehand, so you shouldn't worry too much.

Hi notntodeedyet,
As others have said try not to worry about the letters and any phone calls that you might receive. I'll arrange for some pre-paid envelopes to be posted to you and if you can bulk the letters up on weekly/fortnightly basis and send these into me I'll arrange for letters to be send to the companies. Eventually this should start to reduce but it can take a little bit of time and is normal.
Don't feel scared about speaking with someone on the phone and advising that you have entered into a Trust Deed. As piston broke and Hamish have also said, sometimes speaking with the creditors and advising you have entered into a Trust Deed can help you to deal with things and feel a little better about the whole situation.
When you speak with the creditors they may ask you for a reference number which is issued by the Accountant in Bankruptcy when your Trust Deed is registered as protection.
Don't hesitate to give me a call anytime to discuss anything you are worried about.

Thank you David that will be very helpful

Hi notntodeedyet.
Your letter box and phone will be busy for a wee while. Some letters can have a threatening content - but if your TD is protected they are powerless. Just send all the letters to your IP and you'll be fine, good luck.
Thanks sparky looking forward to a new fresh start well after the 36 payments have been done!
Having recently also undertaken a PTD I know exactly how you must be feeling
I found the process went under a number of steps.
1. Interviewing a number of companies to decide which TD to go with
2. Stopping paying all creditors
3. Signing the TD
4. Getting bombarded with letters and calls by Creditors
5. TD going protected. PTD
6. Letters easing up and calls stopping
7. Managing payments monthly and living within means
That's as far as we have got. The next big step being our first reviews!
As for the calls and letters Having never missed a payment up till we started the TD we had no experience of being chased for the debt. So when the calls and letters started it was an eye opener and very scary. I started by ignoring them myself but passing on all the details to the Trustee for them to speak to the companies. I then started to brave the calls telling the people calling we were is a PTD and giving the details of the trustee to the person calling. I had to do that several times. Now, almost 5 months into the TD the calls and letters have stopped. The only occasional letter we are getting is from people who have taken the debt on from the original Creditors. They seem very persistent and totally unable to update anything. I am however safe in the knowledge that as we are in a PTD they cannot touch us as long as we continue to pay a fair contribution to the original Creditors via the assessed amount our Trustee confirms.
Oh and as for going protected, you should be fine with this. All the companies on here for example know the limits the Creditors will look for in repayment and build this into the numbers. I am assuming this is the case for most companies out there and the success rate of TD going protected are normally very good.
So for us, as I am sure it will be for you now, it's simply a case of learning to live within our means and counting down the months till the end 37 for me and 31 for my wife!
Half way already!
