Hello,

Just checked the AIB and I am now thankfully protected. When do creditors stop contacting me? I keep getting calls day in day out and it is really making me stressed as I just keep repeating the same thing over and over to them.

Just another 34 months to go as I am 2 payments down already - hopefully the time will fly by.

Hi Mercy2604.

Your trustee may be able to contact the creditors that haven't yet properly updated their records to reflect the protected nature of your trust deed. This may help to stop them from calling.

Please don't get too stressed, there's nothing they can do.

Hi Mercy2604,

I'm glad to hear that your Trust Deed has become protected. All you need to do now is finish your payments and you will be debt free.

Unfortunately the creditors can still continue to contact you even although your Trust Deed is protected. Your relationship manager should have explained this to you and that if you do get calls from them, take a fax number and reference number and let your RM know so they can contact them for you.

If you don't let your relationship manager know your are still getting calls then they can't get them stopped for you. Don't feel bad if your having to contact your relationship manager 3 or 4 times a day with information as that is what we are there for. Some of my clients text/email me the details and I get the girls in my team to chase round the creditors.

It should all eventually reduce however you may get the odd phone call now and again. As TDA said there is nothing they can do against you as you are fully protected by the Trust Deed.

Hi, thanks for that. I am a natural born worrier. Yeah I have been on the phone a few times to IP to let them know and to re-send info to them. It seems that it is the creditors that were sent info through TIX. Just seems weird that the individual creditors haven't heard from TIX. My other creditors haven't contacted me from the start so assuming they got all the info fine......I must be worrying for nothing...I just have visions of baliffs coming to the door. Think I will just send all the letters I'm getting from them on to the IP.

I received calls and letters initially. I told myself they could not do anything to me and so calmly told them I had entered into a Trust Deed and I gave them the name of my trustee.

When I received a letter, I wrote back with the Trustee information (I work in an office so it was quick and easy for me to be able to do that). I passed that response and anything else including further statements to the Trustee.

I genuinely had no problems after the first contact they made, and after giving them the trustee's details.

The first call caught me by surprise so I answered automatically and realised how easy it was to deal with it directly with them instead of avoiding calls and ignoring letters; and consequently worrying about it. No-one contacted me again. In fact, it was much easier than I expected it to be.

Thanks for replying. Thing is, I have emailed them all with trust deed info and have spoke with them mostly every time they call unless I missed a call. I gave them info on the phone too and it's like they don't record what I have said therefore getting repeat calls. The main ones that contact me the most on a daily basis is Vanquis and Barclaycard.

I do feel a lot better now I am protected and it's a big weight of my shoulder. Think I may just send them another email letting them know I am protected and send them the trustee's info again.

Hi Mercy2604,

Some really good advice by firewalker.

I find that when you speak to the companies calling you normally they are just advisors who's main responsibility is to collect payments from non paying clients. Sometimes they can be commission/bonus based so the more money the collect the more they make. I think it's for this reason that they don't spend much time putting notes against your file and checking you have actually signed a Trust Deed but simply move onto their next call to make. They will probably have to get through so many calls a day.

It can be frustrating but it should all eventually start to calm down. You may from time to get get a debt collection company on the phone to you who will know nothing about your Trust Deed so just let your trustee know and they will deal with it.

I remember egg phoning to be told that we were going for a TD. The guy was great, said no problem I shall add a note to the file. I pointed out that the wife was entering one too so again he promised no calls. I put the phone down and within 30 secs the same guy phones up asking to speak to the missus!!!

Commission based muppets. Underhand sly devils, and will try all sorts of shenanigans to get anything out of you.

It does get better fairly quickly though and knowing your protected makes the calls less stressful.

Call centres remain one of the ongoing issues pre and post signing. As mentioned above, some of the statements made to get people to make payment are ridiculous.

It's maybe easier for us as looking at these things as we deal with them day in and day out, but it can't be great for people answering their phones and all sorts of sytrange times being threatened with Bailiffs and the like, even though we don't have bailiffs in Scotland.

I always advise that is any one creditor took it upon themselves as their sole task to recover money, it would still take at best 3 months before they were in any legal position to do so as there is a process to follow.

Fortunately with the majority of creditors being dealt with by TIX and GT, it is less of an issue than before as we hassle them and they hassle the creditor as sometimes it may take a wee bit of time for the information to filter through.

It gets easier...

We entered our trust deed in March this year and the calls, letters and even emails came through thick and fast... But all we did was ignore the calls (after your in a PTD they cant really do anything to you if their debt was included) and pass any letters we revived to our administrator who quickly contacted the companies and stopped the communications.

We did have one minor issue where the company who took the debt for my wife's RBS load reverted her name back to her maiden name which started the calls and letters again... but this was quickly resolved again by our administrator.

9 months in and all has been quiet for us. We make our payments, send our wage slips monthly (we don't need to but I like knowing the administrator has complete transparency of our wages given we works in sales and earn commission which constantly varies) and count down the months to the end of the PTD.

Thanks for the replies folks. I received my confirmation letter from IP of protected trust deed today and it tells me what to do if creditors still contact me - haven't had any calls this week so far although I have received a text today but I can handle that...just hate the calls at work, luckily I have a direct line but it's rather embarrassing when I work in an open plan office.

Hi Mercy.

I had a similar experience to you with Barclaycard and Vanquis. They were by far the worst of my creditors, phoning numerous times a day.

I did answer initial calls from them as I was keen to let all my creditors know and hoped that once they were aware that I'd signed a trust deed the calls would stop. That was naive as far as they were concerned.

In the first week or so I also tried to answer the odd call when I could (they phoned repeatedly during working hours and I had to put my phone on silent). I was hoping that by speaking to them someone would take responsibility for getting the calls stopped but to no avail. I finally gave up when I spoke to a Vanquis adviser whilst on the way to a funeral and qucikly explained that I was in a TD and on my way to a funeral so had no time to talk and couldn't offer any sort of payment. Within 5 minutes another representative from the same firm called me on a different number - I was still heading for the funeral. They were completely oblivious to the previous conversation so I gave up and just emailed them asking them to stop, and informed my trustee.

I signed my TD at the end of May and it became protected towards the end of July. Even after that I received calls from both of them. I stupidly answered one in early August from Barclaycard who refused to check the register of insolvencies and insisted that I get my trustee to write to them, when my trustee had already done so and the info was there for them to see in the register.

It didn't finish at that because they passed the debt on to DCA's, who were much easier to deal with, which was a surprise to me. I took calls from them because by that time I didn't think they would be anything to do with my TD but they were actually very sympathetic and had no problems checking the register for themselves.

I haven't had a call from any of my creditors since around the end of August so hang in there, it will stop.

They still send you statements, and Vanquis keep adding interest on. I don't really see the point in the interest as they have to make a claim for what was due at the time the trust deed was protected, or signed (I'm not sure which).

Thank you for responding. Those are the two companies who are constantly contacting me. Today I have had 2 call from Vanquis and a letter this morning which I intend to forward on to my IP. I don't feel worried now since I am protected but looking forward to when they stop calling.
