Six weeks until my trust deed is finished - I get a letter from Santander to tell me I'm arrears with my unsecure personal loan which was included in my trust deed. Well hello - where have they been the past 34 months or so!!!!!!

Why are they still adding interest? I thought entering a trust deed stopped this.? Ah well sending the letter of to my IP and it's been a while since I've last done that - I'm happy to say.

Hi sparky1.

Don't worry about this... they can put whatever they like on a statement but any interest there is imaginary (unless some fairly unique and unlikely things were to happen in the next few weeks).

Hopefully your trust deed provider can encourage them to update their records, though we've heard from a few people now that Santander's systems don't do a good job of recognising and adapting to the consequences of personal insolvencies.

This seems to becoming a bit more common now, but I suspect they are chancing their arm.

They cannot add interest or charges or do anything else. Best refer it over to the Trustee to sort.

I suppose there is nothing to stop them adding interest, but they will only have to write it off again once the trust deed completes successfully. It would only be if you failed to complete your trust deed that it would be relevant.

If you still have all your details of the loan (amount, account number etc), go into a Santander branch and speak to them. I found them to be worse than useless when speaking to them on the phone. If you can ignore it just now and once you get your form 5 (discharge), go into a branch and discuss it with them.

Nothing left to discharge - everything's done and dusted!

I've also noticed that some banks and debt collection companies have written to our clients trying to squeeze a payment out them when their Trust Deeds are nearing the end.

In a perfect world, at the outset of the Trust Deed the creditor would update their records and stop sending any correspondence after that. If only...

Best refer it to your case manager to handle.
