Hi,

I have been on a trust deed for a few years now.ย

In the process of gathering all my trust deed papers, I want to request documents from my trust deed company, all documents and recordings, will they still have the recording when I was advised of the trust deed or will they no longer hold that any more, is there any sort of legal requirement for how long they need to keep the recording for?

Hi NewGuy,ย

Welcome to the forum. I think core Trust Deed regulation says that the Trustee must keep records for 12 months AFTER their discharge. But this 12-month retention period is a minimum legal requirement. Many firms keep records for longer as part of their own internal policies or professional requirements.

Some of our resident Trustees might be able to chip in too.
