I posted on the forum what in my opinion was the worst advice ever on 24 January 2012. I think we may have a new contender!
Just spoken to someone and the advice they were given in a 2 hour meeting was as follows:
*Pay the 1st 2 contributions direct to the advisor and then start making the trust deed payment. That way the Trustee will see that they are committed to making the ongoing payments.
*The Trust Deed must be over 5 years as anything shorter would not 'satisfy' the creditors.
*Creditors will only accept a figure between 20p and 40p in the £.
*Inhibition in place won't matter. Despite the inhibiting creditor receiving monthly payments against the debt until full payment has been received, the Trustee will negotiate this to be cancelled and the creditor will accept a much reduced payment in 5 years!
*It appears from the information that there is equity in the house, but don't worry everything will be fine!
*Stop asking as many questions!
It is as close to 100% unscrupulous selling of a Trust Deed as I have seen and not only is it completely wrong information, but it is dangerous information and represent all that in wrong in the industry.

That's extraordinary Mark. Advice clearly intended to "sell" someone into a trust deed that would maximise the profits of the seller irrespective of the cost to their client.
Was the adviser involved in any way qualified to be giving advice on the subject? I hope you're going to say "no" or it will seem even worse.

You are absolutely correct, it stinks of sign now, he then buggers off and to hell with the consequences with existing legal action and more importantly the house

I'd love to see you go along to one of these companies for debt advice and see what they tell you. Then report back here and we'll all have a good laugh.[:D]

I've always fancied the James bond thing, apparently I have a striking resemblance to Peirce Brosnan!
I've had a few of those 7pm calls at home telling me how incredibly how to sort my debt problems and it's amazing the garbage they tell you just to get a sale. Kind of like a medium where they talk and talk but say nothing at all!

Absolutely shocking, there are no other words for it! Funnily enough, I have come across a few situations lately where people have been told not to worry about inhibitions on properties. It is really scary.

Thats what I got told at the start of my TD. Now at the end there just so happens to be equity in my property and I did worry about it. Seemingly they told me I had £15000 equity according to them. Luckily I came on here and got told to get my own valuation done to which it shows there was only £3000 equity. So plus my arrears. I have £6000 to pay which is more reallistic. I tried to speak with them to say that I got told not to worry about it at the start and now they have thrown this at me was making me ill and I had to go see doctor as was close to doing something stupid.
So again I thank this forum for everything you have done for me.
These company's should not be allowed to operate..
Where there is money to be made and people to exploit cowboys shall be found.
Pity that a decision which could change your life for the better,could be marred by looking in the wrong places for advice,and being led up the garden path by unscrupulous B******S,who dont care one bit about your situation.

I think that is one of the worst things, there is little or no comeback against these guys. If they are referred to an IP, then the IP should go through ALL information before they do anything, the problem is that a number of firms accept the referral, send out the paperwork to be signed.
Once its signed, thats when things normally changed and the agreements/understanding with the 'advisor' goes out the window.

I would hope so, but as long as we/they follow the correct process and have an independent meeting and verify ALL points, then it should safeguard the person. Its the reason why, almost without exception, I take the initial meeting in all referrals and do the post meeting report on matters and also invite referrers to our internal training sessions.
Not ideal as Scotland is a big place, but better than being stuck in the office I suppose. Nice long drive, a bit of Sabbath playing in the car. ( CD I mean, not Live!) Ideal
