Got all excited as a letter from RSM Tenon arrived today,and I expected it to be notice of my trustee's dishcharge(I asked for an update over a week ago regarding the ridiculous chase for non existant ppi!!).
Big disappointment,its simply a copy of the annual report(form 4),and it states on it that the case remains active to allow for investigation of a potential asset.
Getting a little miffed with this,and RSM Tenon are doing themselves no favours with me. Slater Hayward Law or whatever they are called still havent even contacted my to ask about ppi,how much longer is this farce going to take?
It may seem like nothing as I know I have been discharged but I want to close this chapter and cannot do that until my trustee discharges himself.
A limit should be set on how long someone should be kept hanging on in there waiting for it all to finish!!

Just noticed a one liner on there stating they expect this to be concluded by august!!! It does not take that long to find out I didnt have ppi.
Does my trustee continue to claim a fee up until the case closes?

Do you still have your original loan/card agreements, that would clearly state if you didnt have PPI.
If you did have PPi and claim it wasnt miss sold I dont think the phrase "miss sold" refers to whether you were happy to have it. It is more the policy you were purchasing wouldn't have done what it said on the tin so to speak.
I cant say for certain but I would imagine big payouts are being made to those who wanted PPi but it wouldn't have payed out unless they were hit by an asteroid!

I dont have any ppi to reclaim(100% sure of the fact),and have several letters already from lenders that the company tenon have chasing up ppi have approached,all the letters claim that they have looked at my accounts and there is no case to answer. Just cant work out how it takes so long to investigate this. Also concerned as to what would happen should I win the lottery on wednesday!!!! Am I still liable to pay over any windfalls,even though I am discharged?

I'm sure there was a thread recently where someone had a similar fear and I think Mark re assured them that the clients discharge safeguards them from any windfall loss.
After all discharge means just that look it up in the dictionary.

As trust deed assistant said earlier, it is only recently that insolvency practitioners have been instructed that they must investigate the possibility of reclaiming PPI for all of their cases. Inevitably this has resulted in a bit of a log-jam in the system, due to the numbers of cases involved. I can assure you that we are prioritising older cases such as yours so that these trust deeds can be fully closed as soon as possible.
Unlike some other firms, however, in the meantime we are discharging any debtors, such as yourself, who have met all of their obligations under the trust deed. You are therefore already formally discharged from your debts and obligations, it is only your former trustee who is not.
Sorry if I am saying things that you know already, but I think it is worth repeating for any others reading this thread who may be a little confused by the distinction.

The delay applies to all IP firms, however like Kevin, we are discharging cases on the 3rd anniversary and remaining in office until the ppi matter and the VAT issue is resolved.
I would say that these matters were completely outwith our control and have came as a result of recent guidance and also a recent court action. This should have no effect on aquirenda (windfalls etc) as this relates to assets acquired from the period from the start of the TD to the date the discharge becomes effective. Given that the debtor's discharge is recorded in the Register of Insolvencies on receipt of Form 5, I think a Trustee would have a hard time explaining the contrary.

Hi plastic, I spoke to RSM Tenon yesterday & asked the same question about my trustee discharging themselves. The answer I got was that they have a back log of ppi claims. Also they said that they won't contact me even when the trustee discharges himself. I've got my discharge letter & that's all we need. I was to send a copy of it to credit reference agencies. I think we must be at the same stage plastic.
Thanks guys,mind put at rest. Guess I'm just an impatient so-and-so. I want to make a start on clearing up defaults etc as soon as possible but wanted to wait until trustee discharged himself.

Haha barclaycard phoned the wife yesterday to ask why slater hayward law had contacted them,without authority to act. Other creditors have also been in touch to say similar. Why hasn't anyone asked us to sign anything to help speed this up? No wonder its taking so long!

at least you've been discharged. there are quite a few people on here (myself included) who aren't being discharged while the trustee investigates PPI. personally i've been waiting nearly 6 months now since my last payment was made, and i didn't have any PPI on any of my loans or credit cards.....i hope you get it sorted out soon.
I know I am lucky that the discharge is done and that plenty others have been left hanging on,but the clowns dealing with this ppi are unreal,I'd be amazed if they could actually recover any money for anyone!!
