I finished paying my three years of payments to my trust deed almost three years ago. As far as I am aware my trust deed still hasn't been discharged. About 7 months after my last payment, I got a letter asking me to fill out a form about any PPI I may be due.
Now I can understand this as they would be after any other money I might be claiming from my creditors but this was over two years ago and I still haves had everything finalised. I get fobbed off with "oh it'll be sorted soon" answers and suchlike but I just can't seem to get a straight answer regarding when it will all be behind me. I want to rebuild my credit rating as I am paying crippling mortgage rates but can't remortgage as they won't touch me because of the trust deed.
How long do these things normally take and how do I force them to get their finger out and finish it off? Nearly three years is taking the (edited).
Welcome to the forum Bizmuth.
I forget the exact date (someone will step in with it hopefully) but it sounds as though your trust deed was signed before an important rule change.
Nowadays a client that has completed their responsibilities can be discharged while the trustee carries on with any remaining responsibilities that they have (such as PPI claims).
For older trust deeds your trustee simply cannot discharge you until they have completed all responsibilities related to your case, including claiming back PPI.
Three years seems like a very long time though and I think you're entitled to a detailed description of exactly where each of the relevant PPI claims is currently up to.
Sorry that I cannot give you a more positive answer or a solution.
Is the date April 2008?
Trust deed completed Jan 2012,Trustee discharge Nov 2012.
A new dawn.
As far as I remember, it was June 2008 I started paying my trust deed so it is borderline whether I took it out before or after that ruling but I think it was after it. It'll be three years since my last payment in a couple of months. It is KPMG I am dealing with. I dunno how to go about, getting them to sort this out.
If you haven't been discharged from your trust deed, then it will still be on the Register of Insolvencies.
You can check it by going to the Accountant in Bankruptcy website, and following the instructions for searching the Register.
That will tell you the exact date you signed your TD.

Can't seem to find any results. I'm being a bit vague on the dates but nothing seems to be coming up.
Hi Bizmuth
If it was June 2008 then it would be processed under the 2008 regulations which certainly made the discharge easier and allowed for you to be discharged while the trustee remained in office.
I would not have thought PPI would have taken this long.

Hi Bizmuth,
If you signed your Trust Deed after April 2008 then you can be discharged from it whilst KPMG keep your Trust Deed file open to carry out any investigations into PPI etc. Give KPMG a quick call to clarify what date you signed the Trust Deed if you're unsure.
If you feel you have been fobbed off over the phone I would suggest sending a letter directly to your Trustee requesting an update on the status of the PPI investigations and when they intend to close off your file. You also want to request that they discharge you from your Trust Deed and provide you with your Form 5 certificate of discharge if you signed your Trust Deed after April 2008. IF you haven't had a response from them within a couple of weeks chase it up again. You may even want to email them this request.
Let us know how you get on.
