trust deed

My daughter entered into a trust deed on the 1/02/2012 and before that she had made an agreement to pay her own private accountants on the 6/12/2011 a bill of ยฃ460 pounds over 10 payments the first payment was made on the 12/12/2011 then the same accountants although they agreed to the payment then got a court judgement on her on the 12/1/ 2012 even though she was still making the payments per month and still is but they still got a court order put on her i have told her because her trust deed was posted in the press in febuary they should have came forward and didnt so she should stop paying am i correct or am i wrong

You are correct. Court order or not, it is an ordinary debt and payments must cease.

Hi, yes the payments must stop. She needs to contact her trustee to get this sorted.

can they not arrest wages if she stop payments

No, they would be unable to arrest wages or carry out any other action.

That's assuming the trust deed achieved protection...?

5 weeks after the Edinburgh Gazette ahs been published.

Assuming signed on 1 Feb 2012, I would expect the gazette to be forthwith, but say 10 Feb 2012. So 5 weeks should be up on or around 16th March. You can also check Edinburgh Gazette online

Easiest way would be to call the Trustee and have them confirm.

Your daughter should have been notified when the trust deed became protected, so you could just ask her.
