Tax rebates while part of a trust deed?

Hello,

hopefully someone can help. I have been part of a trust deed for around 5 months, and i am very grateful for the help it has given me in getting through and keeping my house.

In the last few weeks i discovered i have been overpaying my tax, and through a second party company i have claimed for my due rebate.

Do any of the experts know whether or not this money should go to me or to my second party? or to my trust deed organisation?

None of the claim is for the period since entering into the trust deed.

Hi chriskay

Its difficult to be exact without knowing the full circumstances, but I suspect the tax rebate is due to you, however as it pre dates the Trust deed, your Trustee may lay a claim to all or part ( or none) of this.

Thanks guys. The total rebate is for ยฃ4.5k, 1.5k of which is due to the third party as a fee for processing it for me. Its to cover business miles i hadnt claimed from april 2008 - march 2012. So i reckon i should be due circa 3k. The inland revenue have said they are arranging to issue to the trustee. do you think i should speak to my trustee to clarify or am i opening myself up?

Your trustee certainly has a right to expect these funds to be paid into your trust deed I'm afraid chriskay. I think you will need to speak to them to make sure that they are aware of the bill payable to the third party who organised the rebate for you, as unless they agree to pay it then you could be left with a hefty bill to pay.
