my wife and i went into a trust deed . just before signed the document we had applied for mis-sold payment protecton the cheque arrived (without knowlegde) just as we started paying the trust deed ,my wife spent the money again without my knowing .i have found out about this and i am willing to pay the money to them through extending the lenghth of the trust deed if thats possible but fear they will say no force usinto bankrupsy through this my wife has been dealing with depression for 2 years and fear this will make things worse any ideas of what the likely outcome will be (sorry missed last query out in 1st post)

Welcome to the trust deed forum piper.

I think the most likely outcome, especially given the circumstances that you mention, is that the trust deed would be extended so that this windfall could be paid over.

Bankruptcy doesnt benefit anyone. Talk to your td firm, they are there to help!!

How much was the payment piper?

payment was approx. ยฃ5400 after the company that applied for the ppi claim were paid as its a joint trust deed i think the payments are around ยฃ350/ยฃ400

have had that thought on my mind aswell but have convinced myself that it will take as long as is necessary to pay it off and i am more willing to comply with it as i don't want the deed to fail , also due to this mistake by my wife i now look after the banking.

How was the money spent, piper? Might it be possible to recoup some of it?

I would speak to your Trust Deed firm. We are not all bad, and I am sure they will try and help you sort this. Your wife's illness may have a bearing on the end result.

without being to direct in asking i'm guessing it was spent on what would be called retail therapy although i don't want to use that as an excuse . as my wife says only things bought of any significance was a washing machine and a fridge/freezer

in reading other topics i.e ppi claims will in a td will my td company ask me to pay the money that was paid to the ppi claim company ?

The washing machine and fridge freezer would count. You most certainly would not have to pay the cost of the PPI firm. Had the trustee claimed the PPI, they probably would have had a claim company do the paperwork for them, and they also would have paid for it.

hi, just a thanks to tda, shona and mark . spoke to trustee today and got all my questions answered without any problems trustee understood the problems and said without any hesitation that they would just extend the td for another year if needed. only wish it hadn't been a holidy weekend i wouldn't have stressed as much feel so relieved now thanks again for the help
