I came home from work today to find a letter from a former creditor that was part of my TD saying they had re-examined my PPI claim and were willing to make an offer. They have sent this money straight to my trustee.

I received my Form 6 from my trustee a few weeks ago but there is still no sign of their discharge on the AIB website.

Am I right in thinking if their discharge was noted on there, I would have had a claim on this money?

Easy come, easy go.....

It's an interesting point, however the trustees discharge is effective 14 days after Form 6 rather than when it's registered. There's certainly an argument that the funds should go to you.

Form 5 came into existence only after the 2008 Regs. The process pre 2008 did not include Form 5. Or 6 or 7.

Just checked my Form 6, which is dated 26th February. The letter from the Halifax stating the amount and that they've sent it to my trustee is dated March 12th - exactly 14 days later! I had actually thought the Form 6 had come earlier. Think I'll contact the trustee anyway. Nothing ventured, nothing gained!

Loking at the dates, the Trustee would have been discharged by the time he would have received the letter. I would agree with plasticdaft that you should certainly fight your corner as the Trustee will have no locus to deal with any funds if he is discharged.

Get onto you Trustee about the funds as like Mark has said, I can't see how they can claim these and you might just be in luck with the timing of things.

As others have said, nothing ventured nothing gained.

Let us know how you get on.

Got a letter from Halifax today. They say KPMG told them they no longer hold an interest in the redress and have instructed Halifax to make payment directly to me! Expect a cheque to be issued in 7-10 days.

Thanks, Firewalker. I got a letter from KPMG today. Probably standard speak but it sounded almost like sour grapes. 'I have no interest in your PPI redress and have told them to forward it to you. If you need to speak to anyone about this, contact Halifax directly'!
