I understood it to be 6 years too, as credit files are just a record of whatever has happened in the past 6 years. Therefore anything that is marked on there shows for 6 years and then disappears. I may be wrong however!

Hi TDA,

I am using one of the companies named on this website. I have given them all my info, bank statements etc and I have paid the £100 to the AIB.

Thanks

That all sounds fine. It looks as though you've looked into the matter carefully and got the ball rolling with the AIB.

Hopefully you'll very soon be Mrsstressednomore.

Regarding the credit file thing,I believe that if a court orders a payment order and believes you have been particularly reckless causing your own bankruptcy then your credit file would be marked as long as the order is in force.

Anything else remains for 6 years tops.

Thank you folks.

Just a thought (at 2.51am) my husband has a creditor which is with the same company as I have. Can they make him bankrupt or arrest his wages just because his name is linked to the same address?

Thanks.

Hi Mrsstressed

No, they are completely different. This would only be an issue if it was a joint loan.

He'll be fine.

Thanks Mark. Even if it's a bank?

Hi Mrsstressed

Yes, including banks. It will be fine, honest.

Thank you again Mark.

I was reading the AIB website and they state that the sequestration is posted in the Edinburgh gazette? I also have a new bank account (joint) I have had the account a couple of weeks. Do I need to inform them that I am bankrupt (when it happens)

Thanks

Hi Mrsstressed.

In terms of your new bank account, some accounts are open to people who are bankrupt and some are not. Whether or not you inform the bank, they may well become aware of your bankruptcy at some point.

Did you look into this side of things when choosing your new account?

Hi TDA.
No I didn't. Didn't know it was relevant until recently. I don't have an overdraft or anything on this account.

Your sequestration isn't posted in the Edinburgh Gazette, mrsstressed - I guess the AIB site must be out of date as this changed over a year ago now I think. It does however get added to the Register of Insolvencies, so your bank may well pick it up from that.

Usually bank accounts are unaffected, though some banks can be problematic so it is best to clarify their stance with them in advance of any potential problems I'd say.

The problem is, it's a new joint account and my partner doesn't know anything about the sequestration.

Hi Mrsstressed

I'm not one to judge but I don't think it's a good idea to hide stuff like this from loved ones, especially if you live together?

Are you sure you can handle all this yourself without being able to have discussions about it? A problem shared and all that. You will get lots of support on here from people going through the same thing but a virtual hug just isn't the same. [:)]

I'm sure you have your reasons for wanting to keep this knowledge from your partner but 12 years is a looooong time to keep a secret. What if you need/want to set up some joint financial doodahs in the future? Your sequestration might cause any number of issues.

Pam
