I have been researching trust deeds and think this is best road for me to go down to deal with my debt. After reading on here I have already opened a separate account with a different bank, but can anyone tell me how easy it is to take my name off the joint account I have with RBS? Many thanks

Welcome to Trust-Deed.co.uk angi3bbz.

Can I ask why you'd like to remove your name from the joint RBS account?

Is there any money owed on that account currently?

Thank you.

So I'm reading into this that you don't want the other person on this account to be affected if you enter a trust deed, and/or that they'd like to continue using this account?

If there is no money outstanding on the account I'd imagine they'll be perfectly happy to take you off.

Only one way to find out though!

Let us know how you get on.

If there's no need for a credit facility I can't see what their objection could be.

Hi angi3bbz,

It should be fairly straight forward to remove your name from the joint account as long as there is no debt on that particular account.

Have you considered all of the potential options to help you deal with your debts and not just a Trust Deed? There are other options available and it's important that you consider these before deciding on a Trust Deed.

We always tell people it's a good idea to sit down with an advisor and discuss all of the options in person.

If you want you could give us an idea of your current financial situation and we could provide you with some advice.

Hi angi3bbz

As TDA says above, there should be no issue with having your name taken off the account, especially if there is nothing owed. As you say, it may help things moving forward if this is the account where most of the direct debit/standing order mandates are paid from.

I'm sure banks used to be a bit sticky on this, but we've had a few trust deed cases recently where this was required and things seem to have been sorted with little or no fuss.

Thanks for replies, I have a mortgage, no equity that I know of as houses in street are selling for less than what I owe, know bankruptcy isnt an option as dont want to lose my home have 3 kids, and after reading up seems trust deed is best option. Mark how do I go about meeting with you to discuss options? As have creditors lettering me they are going to take action if I dont pay full amount, shouldnt have left it so long.

Hi angi3bbz

You can contact me via the contact box and we can run through things.

It is rare for a property to be sold as they are dealt with exactly the same in sequestration as in trust deeds. If there is no equity, then that is usually the end of the matter.

Creditors letters normally get progressively more threatening, although it does take some time for them to actually take the first legal steps, so try not to panic too much. Whatever solution you may choose will normally have the effect of stopping future legal action.

To take your name off the joint account with RBS you both simply need to go to the branch and make the request. They will complete a form, you both sign and your name gets taken off it.

Another option of course is for your husband to open a second joint account with them in his name only and have all the SO / DD etc transferred to it.

Both are very straight forward to do.

They may ask why you want to do this but your under no obligation to tell them. Simply state you want this done due to personal circumstances and they wont (shouldn't) question anymore about it.

Half way already!
