Long wait for Discharge Letter

Hi

My TD ended 25th September 2011, with last payment being received by KPMG in October 2011. I received a statement and it showed my payments and the fact that I the original figure had been more than recovered due to increased payments (salary and surplus was taken into account after a review).

To date I have not received any communications from KPMG. I have emailed and await a reply. I know I had no PPI on the credit cards so this should not be an issue. Has any one else had experience with KPMG and the silence?

Post April 2008 cases should take around 4-6 weeks to close and I'm surprised it has taken this long if you have met your end of the arrangement.

I think you need to apply some pressure for an answer.

In the realm of TD is there an arbitrator or ombudsman equivalent that acts on the individuals behalf?

Generally the IP's governing body. Probably IPA or ICAS.

My advice would be recorded delivery letter asking why the delay and threatening a report to governing body if not dealt with.

I will certainly take your advice. I am reassured that there are bodies that can hopefully put pressure on the IP. KPMG have been fine up to this point, so hoping it is an oversight or a Discharge Letter has gone missing in the post!

Hi abzbudgets.

Give the firm a call. You may well find out that you have been discharged but there has been an issue with communicating this to you.

If you haven't been discharged I'm sure they'll want to see that this is progressed and give you some feedback on when this will happen by.

Check the accountant in banruptcy website and find your entry,that will say if your case is closed.

You have to register to use the site,but its easy to do.

Paul, I discovered the web site. I also discovered that it has not been discharged yet. Another phone call tomorrow is planned. This is a great reference site.

If you signed after April 2008 then there is no reason it should take 4-6 weeks. A form 5 discharging you can be done very quickly.

Hi an update on progress.

I spoke to KPMG today and they say the delay is due to the Life Assurance company not responding to a request to confirm if there was cash value in the policy. What puzzles me is that was established at the start of the TD.

I have been advised that all being well I should have a discharge letter within 8 weeks!! I was told that the time scales are set down and dictate the pace of the discharge.

Why hadn't they started this from the time the payments had been made as planned? It is going to be 5 months! Disappointed that I met the requirements of the TD without fault and that KPMG don't chase up or keep me informed of progress.

I'll keep the forum up to date. I think the Ombudsman need to know about this.

I'm not sure whether that means a discharge should be held up if you signed after April 2008. It does sound like something that could have been done a while ago as well.

The Financial Onbudsman can only help in connection to the advice you had prior to signing a trust deed, so any complaint you may wish to raise about issues arising after you signed should first be made using the trust deed firms own complaints procedure.

I do hope that this gets sorted out for you soon.

Hi abzbudgets,
I also had trouble getting discharged from KPMG and they are truly awful at getting things together. I finished payments last Aug (3rd) and was issued a discharge letter from them in Dec however it had incorrect payments listed (36 instead of 42) but they still had to contact the creditors and didn't issue a final report to them until 16th Jan. I contacted them today to ask when things would be completed and the AiB would be informed of my discharge and was told "we are issuing the cheques to creditors shortly and it should be some time after that".
Keep badgering them and don't let them just say "there is a standard time", it appears that this is used all the time. Unfortunately there are timescales in place for the setting up of Trust Deeds, there doesn't appear to be anything at the end of the process.
