Already in bits with my depression the trust dee company finally call me back today more than 6 months after I paid full and final settlement, so it appears I signed my trust deed on 29th November 2013 although the paperwork has both 28th and 29th dates on it and it seems the lack of any communication in the last six months is because the trustee was questioning my full and final payment they are now saying that I have to pay the full amount as there was new legislation passed on the 28th meaning when I supposedly signed on 29th I couldn't at any point be entitled to pay off full and final settlement and will now be held to full 48months albeit I've made no payments the last 7 months !!! Not to mention I have no job my son is currently under investigation for media cal problems potentially a diagnosis for Tourette's my life is in free fall and I'm

If you can, separate your son's medical investigations and the
Trust Deed into two separate compartments in your mind and life, and deal with each separately. Focus on each as you need to, but they do not belong in the same worry compartment! Otherwise it just becomes a rather large mountain to climb rather than two smaller hills.
The Experts on here may be able to guide you on how to deal with the information you have been given.

Can you clarify exactly what was paid. Was the total sum paid equal to the contribution amount x 48 agreed at the start or was it a lesser amount?

13992 was total amount of debt including wonga and council tax
12528 minus wonga who had cleared all my debt as for council tax I don't know how much arrestmwnts were made but according to council, a damsons and Stirling park I have no outstanding debt which was originally over 6k

Another of the debts for 1600 is due to come off my credit file in August this year and apparently this creditor hasn't responded to any correspondence so I'm questioning this too as the other larger debt has stated on my credit file a zero balance partial settlement on 29th nov to say I feel as though I'm being screwed for want of a better term, can't stop stressing over it all I've got a member of cahms team

First things first - it might be worth double checking the date of the trust Deed, just in case! If you go to the Accountant in Bankruptcy's website and search for your name on the Register of Insolvencies it will confirm if it was indeed signed after 28 November 2013.
If so, then unfortunately the only way the Trust Deed can end early is of all debts are repaid plus costs and interest. However, you have basically paid all your contributions up front anyway, so the only way that you should be asked for any further payments is if your circumstances change for the better I reckon.
On the subject of your council tax, are you saying that the council continued to arrest your wages in repayment of all of the arrears owed to them despite the Trust Deed? The law says that any arrestment for pre-Trust Deed arrears should be stopped once a Trust Deed becomes protected.
Ok I getting more confused by it all every day and seems like it's just getting worse got a sherrifs officer letter today for a parking fine dating back to 2012 ? For £173 which I haven't got again I don't know whether or not this should have been on my trust deed and somewhere is a letter I got last month I didn't really pay much attention to relating to a crisis loan from about 2003 !! I think I binned it but now I'm stressing as to what information I was given is correct or not 🙁 the date its registered is the 29/11/2013 and even though there is 28th dated on the paperwork too the AIB say I'm under the new legislation but they are going to help and assist any way they can with me although it doesn't stop me stressing, finally have received an annual statement that apparently I should have been issued in December but it's taken involvement from a third party to get receipt of this !
Yes I have to clarify the debt that was taken via wages arrestments it looks like the debt may have actually been paid off before I signed the trust deed and I never even knew but surely it was trustees job to clarify any debt I believed to have had actually indeed existed ? My mental health issues are not new have been ill since about 2001 to the extremes of medication although had severe depression since childhood so often my memory is affected, when I took out my trust deed I did supply them with the latest credit check from experience and what I believed to be other debts from council tax arrears etc
Just spoke to Inverclyde council my estimate I have to my trustee for debt etc was over 6k turns out this debt at the time was only 2878, which they submitted to my trustee, although there may have been an overrun on arrestments by about 3 months because the debt was being handled by a third party ! Wages arrestments were approx 350 a month, will need to back track my wage slips and look them out council are going to send me a copy of the paperwork originally submitted to trustee
Just out of curiosity a trustee that is registered to practice in England and Wales how is it possible for them to be able to take over as a trustee for a Scottish trust deed??

If the debt levels have changed, it is your trustee's responsibility to establish this so as previously advised, I would suggest that you discuss this with your trustee.
Your trustee has not submitted a Form 5 to register your discharge so I can only consider the information that has been provided on the annual statement of your protected trust deed (Form 4). However, having considered the money that has been ingathered and the trustee's fees, your total debt level would have to have significantly reduced (to approximately £3642.40) to enable the trustee to pay the creditor in full and this is before the interest on these debts is taken into consideration.
AiB have to ensure that trust deeds comply with the Protected Trust Deed regulations, which have been approved and passed by the Scottish Parliament. I would recommend that you contact your trustee's office to discuss this matter further, confirm what further action they propose taking and agree a resolution.

Anyone got any ideas ? Seriously stressed out and pissed off by everything, contemplating phoning the wedding venue to cancel as don't want anyone else to start putting money towards a wedding that won't happen as I refuse to get married with debt hanging over me and any plans of moving in with my fianc?® are now off the cards also, needless to say my kids have overheard me on phone and now they're distressed 🙁
