The wife and I received letters yesterday regarding barclaycard(were egg cards)accounts which have been transferred to PCO Holdco SarL. Date of transfer 21/12/12.
Given that I was discharged in jan 2012 and my trustee discharged 17/10/12 with a statement of realisation and distribution received by the AIB on the 16/11/12 how can there be a balance to transfer???
Account is being supervised by IVA watch at Grant Thornton so I have fired off an email to the address given querying any outstanding balance and the transfer of said balance.
Is it worth me contacting RSM Tenon given that they ran the PTD?
Barclaycard are the only firm not to have updated our credit files as well so is this just a communication error on there part or are they playing at funny bu##ers?

A new dawn.
Hi Paul.
My guess would be that this is just an admin failure at Barclaycard.
There isn't a balance if the accounts were part of the trust deed.
It doesn't matter that they say it has been transfered as it cannot, in reality, have been.
I have told them I shall allow no less than 28 days for them to update the records, sort out the confusion etc etc before I go to the ICO for advice so I shall bide my time. I knew they would be a pain because our egg loan was also transferred to this Sarl company based in Luxemburg and they appear to be a bit hard to get in touch with.
The egg loan is shown as a prudential loan on my noddle file and is marked as satisfied but then a new entry appears with the same debt owed to this other company(arrow global/SarL) with a fresh default date.
Everybody else has been nice and updated things.

I seem to remember when the ex egg loan got transferred to arrow global/SarL lots of people on the IVA forum got the same letters on the same day(clearly a large batch of bad debts sold on together).
Time will tell.

As expected several posters on an IVA forum from down south have also been discharged from IVAs to find that today and yesterday they got the same letter as myself,I imagine more people will get them as well and hit the panic button.

As you say, Paul, these things are sold on in batches, batches which have obviously not been weeded properly by Barclaycard.
At the end of the day, Sarl have bought some debts amongst their debt that they cannot collect and will have to write off. I imagine they were expecting this to happen in some cases and any price agreed with Barclaycard for the batch will have reflected this.
Is very poor though if Barclaycard feel that this is an acceptable way to operate. I hope the issue is resolved quickly for you, and if not then it is quite right that you should seek to bring them to book. Of course, RSM Tenon would be more than happy to provide any confirmation or back-up that you need.
Would this not be covered under the DPA...?
They have inaccurate information held on you (both Barclays and the debt company). Both will be regestered under the FSA which means they have VERY stricked complainances about holding accurate infromation on customers (future, current or past) to conform with DPA legislation.
For me I personaly would start a letter campaign to both organisations fairly but firmly asking that they correct their infromation and seek assurances this will not happen again. Highlight to them the potencial breach of DPA. Ask Kevin and his team to send you conformation (if its required) to support your case and their inacuracy. Finaly (and most importantly) demand that they imediatly correct the credit file entry showing this was an error and have it back dated to the inital setelment date of the TD as appropriate.
The longer this sits on your credit file the long it takes for you to start bulding a new, good credit history.
I would send it to the CEO of both companies. Google will give you the name of the contacts. Do not mark it for there attention. Instead write it as if you are addressing them directly. They all have specialist teams who deal with executive complaints who will pick up the matter on the CEO's behalf. These teams typicaly have more weight then standard complaint teams and can move things allogn quickly.
If they refuse to deal with your resoanble request after a few attempts (they have 8 weeks to try and resolve the case from inital complaint) then ask for a dead lock letter (although not nessesary) and inform them you are going to the FSA with your compaint.
Financial firms are charged by the FSA for just receving and addressing a complaint regardless the outcome and they try to adviod this where ever possible.
Chances are however this will be easyly sorted quickly without going to this length to your satisfaction.

Half way already!
I got one as well. I figured it was some kind of error and I chucked it in the bin. In my defence I was off my 3rd nightshift and not concentrating. It said they woulld deal with my trustee so I might fire an email off to him and see if anything pops up.
Nothing left to discharge - everything's done and dusted!
Thanks Kevin. I shall wait for an email back 1st before letting Nicola Boyd loose on them!!! Actually quite handy the letter arrived as it has decent contact details for sorting out default dates etc.

According to an IP I know down south this Sandra woman is a very diligent professional so if anyone did get a letter dont hesitste to get in touch. She has even offered to look into sorting my credit report entry for my egg loan which was also transferred to barclaycard and onto another firm that she acts on behalf of (not her personally but grant thornton).
Very helpful indeed.
