I am sure I have seen many posts on this, but struggle to find to review answers so sorry for posting a similar question.

I paid my last payment on my Trust Deed in December 2011. Despite writing twice to my trustee, I have not heard anything back, even acknowledgement of my communication. I know most people say 4-6 weeks but having not heard anything for 2 months, I look forward to hearing officially its all over.

Any advice?

I think you should demand an update. If all matters are concluded, it should tale about 4-6 weeks. Even if there are matters outstanding, there is nothing to stop you being discharged and your trustee continuing in offece for a period to conclude things.

I have written to them again today asking for an update in next 7 days. I checked Register of Insolvencies and this does not show finalized, also when I checked Credit Check, it still shows outstanding on the main creditor.

I will also try to phone again this week. Its the slience more then anything that is frustrating.....

my entry on the AiB webstie still says nothing about our TD being closed despite getting a note of discharge on the 8th of feb,I am guessing it just takes time. My annual credit report says the TD is finished though,but I dont know where they get their info from.

Today I received a reply letting me know that I should chase in 12 weeks if I have not heard back. The delay is due to a lengthy and recently increased statutory process involving your creditors, Inland Revenue and the Accountant in Bankruptcy.

I presume Inland Revenue / HMRC aren't a creditor of yours?

It sounds like this is to do with the VAT issue which has been discussed here a few times recently.

Lots of firms aren't seeing the situation with VAT (which used to be charged on trust deeds but now isn't) as being a reason for any significant delay in discharging their client. A shame that this isn't the case for you if this is the stated reason.

Did you sign after April 2008, nearly finished? If so, there is no reason you cannot be discharged even if your trustee feels it is necessary for him/her to stay in place until the VAT matter is settled.

IP's appear tpo be using the VAT thing as a reason for not closing cases, however as Kevin mentions, if the case is post April 2008, then there is no reason why the individual cannot be discharged and the trustee remain in office to close the case.

I was discharged at about the same time as Paul but I'm not showing on the AIB website as such. I also got a letter from my trustee saying that although I was discharged, they would remain in office to settle any PPI claims. This is laughable as I emailed them and phoned them to tell them I was never mis-sold. Now I think, you know what, knock yourself out. Feel free to do the leg work. They have it in writing and a covnversation from me to say there was no mi-selling but clearly I haven't a scooby what I'm talking about. They have till I get back from holidays in the summer then I'll speak to them again about it. I'm just happy I don't have anymore payments to make.

They're also going to charge a fee of ยฃ3000 for the pleasure of this pointless task.

Nothing left to discharge - everything's done and dusted!

So they're adding a ยฃ3000 charge (to your creditors effectively) to check whether any PPI money can be claimed after you've told them that in your view it cannot?

Precisely! As far as I'm concerned, I've told them I wasn't mis-sold so if they pursue it, it's fraudulant. I'm almost tempted to post a copy of the email to anyone I had PPI with just so as they can post it back to who-ever's chasing it.

We got a call last year from a guy that runs one of the PPI claims firms that at least one trust deed provider was using.

He wanted to challenge us on the contention raised in this forum that just because someone didn't feel they had been missold PPI that a claim shouldn't be made.

Maybe he was right and I and other members are naive. Or maybe there's a lot of claims-farming going on due to it's lucrative nature.

We have often seen examples here where the way claims were being approached was creative or dodgy according to your viewpoint. To be fair though, it's no worse than the dodgy way our major financial institutions fleeced millions of people with these products in the first place.

If you knew you were buying ppi then it hasn't been mis-sold. Several trust deed firms are simply trying to cash in on the fact that the banks are not contesting claims for ppi!

Hi there

Looking for some advice. I have had a trust deed for four years, it was extended due to having to reduce payments for a while for cost of living increases. I made final payment in Nov 2011 and i am still waiting to be discharged. I have made countless numbers of telephone calls to the company dealing with this, only to be told it will take as long as it will take! The company in question has recently undergone a merger and my last telephone call today was met with the excuse of we have new systems to get used to and i cannot give you a date for discharge at this time. So basically my life is on hold. I want to know is there anything i can do about this or do i just have to wait it out? [:(]

Welcome to the forum Kaz.

Sorry to hear that your discharge is being delayed.

If you've lost your patience on this you have the option to make a formal complaint to your trust deed firm. If that doesn't result in an outcome that you're happy with you also then have the option to complain to the professional regulatory body of which your trustee is a member.
