If I am coming across as irate, I cannot apoligise for it. You guys have done nothing but help and I appreciate that.
But getting to the end of my tether, want my life sorted and changing the goal posts when it suits them without any information being sent to me on my so called future assets(PPI) is not very professional or bodes for a good client/ TD relationship.

I get so frustrated and angry when I read these posts. I have been there I have done it . I know how difficult it is to get discharged but at no time did I entertain the thought of giving up and let these companies walk all over me, as I said in one of my posts ,do not take no for an answer, if you want discharged you keep at them day after day with letters phone calls even personal visits if that is what it takes. You become such a thorn in their sides that they will be glad to see the back of you. I will say it is not easy but if you do your homework and stick to it ,treat every set back as a challenge not a reason to give up because that is exactly what they want you to do. They can and should discharge you. If it worked for me then it can work for you. Angiepal as you know I was in the same situation as you ,I too got the same bull in a letter but I kept at them and am now discharged. Don't give in.

I will continue with the letters and will do so til they get sick of me and my name.....think paying a visit to the office will let them know that Im no gonna lie down to their cheating games.

I think that part of the problem (aggravated by aggressive advertising) is that trust deeds are seen as 'write off your debts in three years'. But, it's not always quite that straightforward, unfortunately.
angiepal, before doing anything else, why not send a calm response to your trustee, thanking them for their explanation that "Each Insolvency Practitioner's trust deed can contain different terms".
Ask them if they can point out the specific part of their trust deed which is relevant here, to help you understand their position.
I'd also be inclined to ask for more information about this part: "Due to the importance of this matter, I have contacted Legal agents for advice in relation to this".
It sounds very grand, but what exactly does it mean? Your trustee has told you that the 2008 regulations apply, and that each IP's trust deed can contain different terms.
We know from this forum that ICAS have given guidance/instructions on how trustees should deal with potential PPI claims. So, why the need for legal agents?
I think candlewick makes a fantastic point and also very good recommendations.
If you turn on the TV and a guy tells you he's an expert on trust deeds and you have financial worries, guess what this guy is likely to try and sell you. I think there is an inherent problem with some firms where it is all very positive to the point of signing and then little or no communication afterwards. In effect, you get 'shelved'
Personally I hate the way debt is now being marketed as it used to be a service, now it's a product. To deal with Trust Deeds at the front end, I think people should have at least 5 years+ experience, unfortunately insolvency departments have become call centres and trust deed factories where fees are king with little or no regard for creditors or the individuals. That said I know a huge amount of very very good firms who still believe in the core values.

Angiepal i can understand your frustration hun, i am still fighting my situation out with kpmg and i literally have to grit my teeth and count 1 2 3 so i dont blow my temper everytime (My partner used to hide when i got a letter from kpmg as i was like a bear with a sore head), there so unhelpfull, and rude.
We are both having problems with kpmg but for different reason but both want out and cant seem to get out. where is the justice in that?? for you especially you have ran the course you have done your part, they should give u the discharge and let you get on with your life.
My suggestions:
Write your formal letter of complaint and list it for complaint department or head manager of the office.
I would not call them or speak to them in person as much as you want to head to the office and let them have a piece of your mind. You really will have no record of what is said. I called them various time before i came here to trustdeed.co.uk and they conviently had no record of the said calls and despite what i told them was said they would not take any notice of it because in there eyes it didnt happen.
Make all correspondence in letter (preferably sent by recorded delivery) so you know when it was recieved and also so you have a copy of them so if you are having to make a formal complaint to icas as i have done you can enclose copies of the letter.

Yes andy i checked the icas website for the relevant information i need to be placed in my letter of complaint and checked the contact section on there site for the relevant office. I was little unsure if i had to send it to there main office or if i could use the glasgow office so i emailed them and was told the west nile st office was fine.

Yep all your suggestions on board and tonight I will write another letter, asking the relevant questions and send it to the complaints department.I am also keeping copies of all their corrospondance and mine.

I couldn't agree with Mark more. My rule of thumb is: if they are the ones who approach you, then it is a sales pitch and not about service.

Well received a reply from KPMG-
They sent a copy of my trust deed and it does state :-
Section 14-6
If my trustee decides not to grant my discharge he shall inform me in writing of the fact,and the reasons for so deciding and accordingly I will not be discharged from my debts and obligations in terms of the trust deed. Intimation to me of the trustees decision not to grant my discharge shall be deemed to be made by a recorded delivery letter sent by my trustee to my last address known by my trustee.EHHH Never received nothing in writing!
They Quote this and regulation 19 of the trust deed act then go on to say below>
Basically they telling me no claim has been made on my behalf for PPI(albeit all the calls since March telling me no discharge cos they investigating my PPI!)They deciding whether it cost effective and have sent me a payment protection insurance Questionnaire (should I fill this in?)
I have no idea if I was miss-sold, what I do know is that with the credit cards I asked for protection in case of illness or loss job etc.
So I should fill this in saying so?????
They end the letter saying they will be in touch again after speaking to their legal agents(already asked before for them to clarify what they mean by this), still not answered me just repeated it again!
So no further forward and tearing my hair out...what to do now guys??????

I'm only answering part of your questions here, but I'd suggest honestly and fully completing any PPI questionnaire as soon as possible.
Failing to do so risks additional delays for you.
I would agree. Complete the questionnaire as fully as possible and return with a letter asking that their investigations happen urgently given that you have fulfilled all of your obligations under the trust deed and would therefore expect your discharge not to be unduly delayed by any further prevarication on their part.
