My Mum entered into a Trust Deed nearly 4 years ago and I'm hoping she is just about to be discharged from it.
She recently read somewhere that as she works in the care sector that she should disclose the fact that she is in a trust deed to her employers.
As she is now in a process of applying for a new job does she have to disclose this in an aplication form?
Its a job caring for people with learning difficulties, mental health and autism etc.

My understanding is that disclosure would normally be required where an application form or interviewer asked the question, where a regulatory or professional body require it to be disclosed, or where there is a contractual obligation to disclose it.
There may be other reasons that others could share.
Obviously I don't know whether any of these would apply to your mum.
I suppose its more likely to be a requirement if she has access to the financial resources of vulnerable people.

Thanks for your help. I'm thinking the best way forward is to make an anonymous phonecall and ask them about it.
It doesnt ask for it in the application form and shes not a member of a professional body so it may be whether there is a contractual obligation to disclose it. I'm assuming they'll not carry out a credit check but I'd rather her disclose it than get sacked for not disclosing it in the future.

From the information that you state above with regards the job it sounds like a Disclosure Scotland background check would be carried out on each individual that was successful and more than likely it will be the Enhanced check. Not sure if financial information appears on it but since a trust deed went through a Court there is every chance it will as speeding tickets show up. However I wouldn't be put off by it, if it doesn't ask the question in the application then you can't answer it. I work in the Health sector and except for the obvious reasons, one of the reasons they use these checks is to see if your are honest.

As far as I am aware, a Trust Deed is a formal agreement between you and your creditors, overseen by a Trustee and regulated by and registered with the Accountant in Bankruptcy. There is no court involvement, that I'm aware of, therefore I don't think it would show up on a CRB check

I've just had my disclosures done and my trust deed isn't mentioned on it anywhere.
Nothing left to discharge - everything's done and dusted!
Disclosure is now pvg scheme and still doesnt enquire on formal or informal debt arrangements. A call to employers human resources asking about debt issues can be made anonymously to ensure no contractual issues apply.

A Disclosure Scotland check is purely concerned with criminal matters, not civil. Even if someone had been made bankrupt through a court process I do not believe it would show up as this is still just a civil procedure.

Only a finacial check will show the TD along with your credit infromation.
Some companies who specialise in perfroming employee background checks will look at both but you should be informed of this in advance.
Unfortunalty there is no way you can preform a check on youself as this is designed as a sercure thrid party process to vet an employee.
