how do i get them to stop calling?

Hi,
here i am needing more help!
I signed my trust deed and it became protected about two weeks ago.
One payment down and all my creditors have been great apart from one. Sygma bank (creation finance) are constantly calling me.
I have told them I am in a TD, have given them the IP details and I have also sent them another copy of the docs that I got from IP when it was put in the gazette. Sygma are still saying that they do not have any of these and will continue to call me until its resolved. I always answer the phone and explain the situation each time, and they say they are not allowed to contact IP due to data protection.
How do I get them to stop phoning me?

Hello again teejenny.

I'm pleased to hear that your trust deed has become protected.

I suspect that Sygma Bank have failed to update their systems promptly with details of your trust deed.

If you've given them permission to speak to your Trustee they are hiding behind a data protection smokescreen; they can perfectly easily contact your Trustee without breaching any rules.

Perhaps easier though would be to ask your Trustee to fax them, confirm that they are acting, and request that they cease making contact with you directly immediately.

hi teejenny,
I had similar probs and informed trustee on each occasion. updating records always seems to be the problem and as i knew they had been informed by trustee and myself on more than one occasion i informed them i would not be accepting any further calls and ended the call. i could do this in the knowledge my TD was protected and it acctualy felt quite good.
calls stopped quickly after that!! good luck

Aye i had very similar problems at the start of my trust deed in Oct 2010. It took months for creditors to finally stop calling. Each timei told them about the trust deed. I also ended up having to phone my trustee person and she dealt with them.. It took more than a few calls from my trustee before the calls finally stopped.. THEY DO FINALLY STOP. It just takes a bit of time.. I used my caller ID and just didn't answer them.. I also got threatening letters which i faxed copies of to my trustee and they dealt with them as well. It is a HUGE relief when they finally stop..

Something a lot of us are very reluctant to do- change a phone number, request a block on certain numbers or answer and just request that personal finances are something you choose to deal with in writing so everyone has accurate records. You are not obligated to feel hounded because of financial setbacks or even mistakes and mismanagement.

While it is very annoying you are protected by the trust deed. Next time they phone inform them that you are recording the call as you are gaining evidence of harassment,ask for the name of who you are talking to,you will find this speeds up the records being updated!!!

My experience is that a good trustee will take on the responsibility to make an intervention to the companies concerned to stop the letters/phone calls.

Tell your trustee teejenny, they should contact Sygma directly and hopefully that will put a stop to it - though as Amerififer says, sometimes it can take a few calls/faxes before the creditor finally sorts themselves out unfortunately.

Hi

Your Trustee should keep making contact with them to stop the calls, however, as Kevin says it can take a while for them to update their systems. I have known people to use the same tactic as plasticdaft mentioned - tell the creditor you are making a case for harassment- it can help!

We got an apology letter from egg for being slow to update their system. It was more annoying as they would phone to be told I wasnt able to pay due to the TD and that my wife was the same,they would say fine we will update the records then phone back 5 minutes later to ask the wife for a payment!!!

Its worse when they start to phone your work and mobile numbers!!!
