Finally out of my PTD

Hi all,

I finally paid off my PTD on 01.02.2023 and finally discharged on 14.02.2023 on the AiB website. My Trustee has not discharged herself yet and I was wanting to ask a question.

I own two properties and I would like to sell one of them. My question is, do I need to wait until my Trustee has signed off or can I go ahead and start the process of selling one of my properties?ย

HI BMC.ย  Congratulations on successfully completing your Trust Deed - I imagine you must feel great about getting to the end finally?

Your discharge means that your Trustee no longer has any rights over your property or other assets.ย  In fact, part of the process they have to go through in order to discharge you is to remove the inhibition that was registered against you, which would have stopped you selling any property without their agreement previously.

The only reason your Trustee is not yet discharged themselves is because it takes a little time for them to distribute any funds they have gathered in to your creditors before fully closing the Trust Deed down.ย ย

Hi Kevin,

Thank you so much! It certainly is!! It has been a long, drawn out process, but worth it.ย 

Thank you to everyone on the forum for putting up with my posts and many questions! You have helped me so much.ย 

I was able to speak with the closure team after several attempts today and they too confirmed what you have said. They said it should take up to 6 months, but they are rushing through closure cases right now and I am very close to the final closure. Once I see the date appear on the AiB website I will be able to then sell my house which is great news!!ย 

I am now so happy finally completing the PTD and can now look forward to moving on...

Hi,

I had two years left of Equity to pay off (two houses and one car). I was able to sell my car to pay off the balance. My annual review was due in May this year, so I was able to pay of the balance before the review date.ย 

I suggest you wait the two months and complete. I am sure it will fly in! ๐Ÿ™‚

congrats on completing your TD.

My situation is the same as yours and Iโ€™m worried about proceeding with a sale.

when you called the closure team, did they say you can sell when you see your discharge date or when the trustee discharge date appears on AIB?

Not sure why your message is all truncated, th34ft34e, but to clarify: It is the "debtor's discharge date" that is the important one. Once that has been entered on the register of insolvencies then the trustee should have relinquished any further interest in the property.ย  I think that it is wise to wait until the Trustee is discharged too however, just to err on the side of caution as you don't want any sale process to be held up due for any reason once it has started as potential buyers can be put off.

Hi all,

As Kevin has perfectly said, I was told to wait until the Trustee discharge date is shown on the AiB website. From there I was told I can begin the process of selling my house. I keep checking everyday now hoping to see that magic date appear! But I have been told it can take a couple of months for trustee to finalize the monies.ย 

I will keep everyone updated on the progress!ย
