does anyone know if you are said to have had excess income during your trust deed should this be addressed at your regular reviews when you send in your wage slips and bank statements, and your payments adjusted accordingly, or is it it normal pracice for this never to be mentioned until the last review then your trust deed extended to pay it back. all advice and help much appreciated.

thats what i was led to believe at the beginning of my trust deed, and this was why i was told there was a need for the reviews to be carried out. i have brought this up with my trustee and asked why my payments weren,t increased to reflect the excess income but she said i couldn,t afford a payment increase. sureley this is a contradiction. i dont think it is fair for me now to be penalised due to the trustee not doing the job properly at the time of the review. is there anything i can do about this situation it seems unfair im going to be on my trust deed for nearly five years, thats not what i signed up for.

If you have sent in your update, payslips etc, then the onus is on the Trustee to look for increased payments at the time. Certainly not do nothing and seek retrospective payments later.

i sent all my payslips bankstatements in when asked. on my first two reviews nothing was ever mentioned about excess income it wasn't until the final review it came up. i have at no time during my trustdeed ever felt i had excess income its been a tough 3 years, and i feel like you it should have been dealt with before now. i have tried talking to them but as yet no joy. i am writing a letter voicing my concerns and i will take it from there. the trustees assistant also counted my excess income twice which made matters worse also.
