Hi sorry to b a pain in the ass, back again, i'm needing advice on what to do? As from previous posts, i'm still awaiting discharge, its been sitting in a tray for 5 weeks awaiting a signature, everytime i phone the office, the girl just pams me off saying it'll be done when its done! She says it has to be the manager of the office that sign it off, i'm anxiously awaiting it to be signed, i was hoping to have had this wrapped up by xmas!!! Please anyone can advise me what i should do, its like banging my head off a brick wall thats it nearly 4 years!!!

Hello lhenderson.

You do have the option to make a formal complaint if this company has exhausted your patience. It certainly seems as though you have given them every chance to get on and do their job.

If you were minded to do this I'd suggest that it is in writing and personally addressed to your Trustee. His or her details should be on the paperwork that has been sent to you by the trust deed company.

Thanks TDA, I'm just at my wits end with them, nothing i say is hurrying them, i've just phoned before i do a letter of complaint, a girl answered by just saying hi, i thought i'd got wrong number, anyway was told the girl dealing with my case is now on holiday, so much for getting back to me, so i've asked them to find out whats happening, we'll see if they call me back, although i'm doubtful that this'll be done x

As I mentioned before lhenderson this site certainly does not exist to promote the making of complaints against Insolvency Practitioners and trust deed companies. Most of them do an excellent job for their clients.

However there comes a point at which you'll have to make a judgement about whether you should be able to expect better than the service you are currently receiving. After all, you have been patient already and you have paid them thousands of pounds in fees.

Sounds like you are with the same IP as me. My TD was 3 years on August 2nd. and I am still waiting discharge. I experienced the same problems with my IP. He was never available and his staff were anything but helpfull. I telephoned late August to find out what the next step was and was told by an assistant that I should stop payments as I had made the 36 required. On phoning yesterday in response to a recent statement to Creditors stating we were still paying I was told that the instruction to stop paying had been wrong as the ammount I had paid was not enough. Now I dont know how much more I have to pay and if I will ever be clear of this TD.

Welcome to the forum angusog.

I'm sorry to hear that you are experiencing the same communication and closure issues. Sadly there appears to be one or two trust deed companies that simply don't understand that they are in the business of helping people as well as meeting regulatory standards.

I would suggest that you write to your Trustee, addressed personally, requesting a full statement of your payments to date, and also written confirmation of any further responsibility that they state you have.

Hi after months and months of waiting on a response its seems my threat of putting a formal complaint in place has given them the kick up the ass they needed, i now have a letter which has been sent to the creditors asking for my discharge to be put in place, it also comes with a yellow letter about "proxy"? Can anyone tell me what this is?? Do i have to do anything with this? thanks

Hi lhenderson

A proxy form is used when there is a creditors meeting and the creditor cannot attend. The form allows a nominated person to act on their behalf.

You don't need to do anything about it.
