We used RSM Tenon and have had nothing but prompt service from them, whenever we have had to call them. Very approachable case managers which makes a big difference.

Had meeting with Cheryl and collected paperwork from her today to look through. Have another meeting with her tomorrow but I have to say the paperwork is scaring me. I currently think I am in negative equatity so dont think I will have to do anything with the house Cheryl says they will do a valuation to check. But I am concerned with how likely it is for the creditors to refuse and then they put me into sequestration and I will lose my house? Has anyone come accross being refused a trust deed?

Marie, I know it's easy for me to say now but I've went through the same worries as you did regarding would my creditors agree to my Trust Deed becoming protected....

The simple fact is that a good company such as RM Tenon will know exactly what your creditors require for them to accept the Trust Deed, and that's exactly what they will propose, so if they are confident then it should go through. If they thought your creditors would object they would not have recommended a Trust Deed.....

Anyway good luck and hope it all goes smoothly.....

Hi marie.

Have a read of the interviews with Kevin and the other experts here (on the main menu to the left). They talk about the percentage of trust deeds that become protected at their firms. I think you'll be reassured.

Major creditors tell these firms what they will and will not accept which means surprises are very rare.

Hi Marie

As said, we have a good idea of what creditors will accept before putting the proposal forward. In the off chance that it failed to be protected, Sequestration does not mean you will automatically lose your house. If there is no equity, it will be fine, sequestration applies the same rules as Trust Deeds when it comes to property. You will be fine, I am sure.
