Hi. The 35 day's on the roi was up yesterday. But I haven't heard anything from my trustee as to if I'm protected. My calls from creditors has increased which makes me wonder do they know something I don't? When and how will I find out I'd I'm protected?

Call your trustee and ask. Its often a case of if you hear nothing all is well.

Hi Tallpaul.

Protection doesn't actually happen until it is registered as such by the Accountant in Bankruptcy, so it may well be that your trustee is waiting for confirmation of protection back from them before notifying you.

I never got any Comms from my original Trustee, just kept checking the Website.

Hi tallpaul,

As plasticdaft has pointed out normally no news is actually good news.

Upon the expiry of the five weeks the Trustee needs to complete paperwork and send this to the AIB for registration. This can take a week or two to complete.

We actually give every one of our clients a quick phone and/or text to let them know that their Trust Deed has successfully become protected. Often this is the biggest worry for a lot of clients even although we try to reassure them as much as possible. From being involved in the forum it's allowed us to change some of our processes and provide better customer service to our clients. This and current status report feedback was a couple of areas we tried to improve on.

Perhaps give your Trustee a quick call tallpaul to find out about your case.

If you look at the process, the 5 weeks starts from the date of the ROI notice and therefore, as you say, the 35 days have passed. Following the expiry of the 5 weeks, the Trustee will need to send the paperwork to the AIB for registration as protected and this may take a couple of days to a week. Following that, the AIB would need to register this, which again may be a few days.

I think registration in reality is unlikely to take place in the week following the expiry of the 5 weeks and more likely to be the following week. If that makes sense!

I think if there were any issues, the Trustee would probably let you know, but probably best to give them a call to double check.

The 5 weeks thing is always the bit people panic about, however as long as the trustee stick to the guidelines and criteria, there are rarely any issues.
