Trust Deed Forum
Afternoon,
I entered a trust deed with Carrington Dean in January 2024 with it being active the following month, this was also at a time I was due to remortgage. when doing my initial budget the mortgage payment was incorrectly quoted to me by Natwest (hadn't applied my repayment from previous deal during lockdown and holiday payments). Long story short I was out around £200 from what was listed ion my TD and what I was actually spending. Despite efforts to get this sorted I was told it was effectively too late and i'd need to wait until the next annual review.
So 12 months on from what was probably that hardest financial year of my life, I tried contacting CD to arrange the annual review. Despite numerous efforts, emails, phone calls to overseas departments, this review wasn't done until November 2025 as it was impossible to get in contact with anyone who could speak English. Only after when i posted a google review did someone from Creditfix contact me asking first to remove my review, and then they could sort the review - sounds like blackmail? Anwyay, got the review done and payments were finally reduced to match the mortgage figure.
Recently, there have been a few very unfortunate and unforseen events which ive had to pay/ help pay for (mother in laws funeral), that's now left me without the money i need to fix my car which then costs for for me to get to and back from work and i cant help feeling this would never be an issue if contacting them was simpler? The constant stress of dealing with such an incompetent company is deeply affecting me. It is IMPOSSIBLE to speak to someone from the UK.
Is there any way to break your TD or transfer it to a different broker? Should I complain to the Ombudsman? I feel it wouldn't get me anywhere but i cannot handle this anymore.
Further that, reading recent google reviews has installed more paranoia that once my TD is complete, it seems like a lot of people are still having to pay their debts due to them not being paid during the TD by Carrington Dean - I think from my statements, from the £17,000 I've paid thus far, only a few tho9usand has reached my debtors, with the rest being listed as CD's Admin fees.
Be very wary of using this company, i would genuinely have preferred to go down the long route of paying it back myself without them.
Hi Andy,
Firstly, sorry to hear about the problems you have been having. I have provided some additional info on the points raised, below:
1. Had to wait 12 months for first review
This is not the correct procedure. The Notes for Guidance require that your Trustee review your income and expenditure AT LEAST annually. Ad hoc reviews should be held when there is a material change in circumstances.
Such a significant change early on in the process could have been grounds to consider terminating the TD, or extending payments to cover the shortfall to creditors, but a review definitely should have taken place.
2. Delay in review after 12 months
As above, the Notes for Guidance state that your circumstances should be reviewed at least annually. The relevant section is 6.1 of the Notes for Guidance.
3. Unexpected expenditure / car maintenance
A payment holiday may be available (this would allow you to take a break from contributions to cover the car maintenance, with the missed contributions added to the end of your schedule). This will depend on the costs of the repairs, whether you've had a payment holiday already, and the overall impact it may have on the TD, but it is something to discuss with the Trustee.
I appreciate that your main difficulty is reaching someone to arrange this. You may want to check the Register of Insolvencies for your Trustee's name and try to email them directly.
4. Can you break or transfer your TD
Short answer: No.
When granting a Trust Deed, you vest your estate in a Trustee. There is no mechanism for the granter to seek an alternative Trustee.
If you breach the terms of the Trust Deed or cease payments, the Trustee can instruct your employer to deduct contributions from your wages removed link If they terminate for non-compliance, the costs will be paid first, with the balance paid to creditors, who will be free to pursue you again and add interest and charges. Given you are quite deep into the TD, this would not appear to be a good result.
5. Complaint
You should follow the Complaints procedure on Carrington Dean's website and, if unsatisfied, you can escalate your complaint via the Insolvency Complaints Gateway, which will go to the Insolvency Practitioner's Recognised Professional Body. They may sanction and/or fine the Insolvency Practitioner if they are found to have breached their duties or the Insolvency Code of Ethics.
6. Your liability post-Trust Deed
Once an individual has received their discharge on Form 5, creditors cannot enforce debt or insist on repayment. Your liability is discharged, whether the Trustee completes their obligations or not.
Fees and costs for Trust Deeds are approved by creditors at the outset - I wouldn't worry too much about these (the only time they will impact you is if you come into sufficient funds to repay your debts in full whilst still in the TD, then you also have to pay the costs and charges; or if your TD is terminated, then the costs are taken first with the balance available to creditors). A typical trust deed will return between 10p and 40p in every £1 to creditors.
