Hi everyone most of you know my story so i wont ramble one.
I finally got a letter back from my TD Company this morning and there basically saying no we wont discharge u. Telling me if i dont continue making payments as of march the 1st they will take action against.
So suggestion on what i do next???

What an extraordinary response to your situation and request.
Please don't panic at this point. As you have no major assets and your income is based on benefits I'm not sure legal action is, in reality, at all likely.
There is a very senior person at the first company you spoke to looking into this situation. My colleague who knows him will get in touch again at the start of next week and see where they are up to. Hopefully they will feel the same about this development as everyone else reading your story will do and choose to try to exercise some influence.

Their response is laughable. I appreciate your concern at their 'threat' but you are 100% right here, no doubts whatsoever.
They can do NOTHING despite their pretend threats of action.
The actions of this firm are embarrassing from initial contact to the most recent letter and I'm happy to go on record/forum and state this.

I've been basically on bit of an emotional rollercoaster since i got the letter, anger one minute to tears the next, wish i had never got into all this.
They made the explinations to my questions but openly admitted that they knew all my income was benefit based. Even openly admitted there error in including my housing benefit as part of my income when i never actually recieved it said they would amend the error to reflect true numbers. He said i signed paperwork in agreement to this. I openly admit i signed a lot of paperwork on the day of the trust deed. My partner can even confirm this it was page after page which i assumed was all TD Related to what was about to happen, not anything related to conversation before hand (Ie:the fact a third company was recieving 650+ of my money a company that was suppose to be free debt advise) so if thats my only my charge then yes i'm guilty, they sent me copies of what i signed and the bit in which the referral was listed nowhere on that paperwork does it state i agreed and signed to agreed they could recieve this money.
They say even after the removal of the housing benefit i can still afford to pay the trust deed but in honesty i cant i looked at a copy of the figure they sent me and infact a few of them are wrong they said i paid 20 for my telephone i have never stated i paid 20 my bills always come in at between 50 and 55 (Because i have broadband too) infact i provided them with my most recent phone bill the day i signed my trustdeed. so this is not a reflected correct amount, it also states on figures i pay tv rental again this is not the case i never have had any rental items, my homes insurance payment is wrong and they never updated the fact my electricty payments went from 50 a month to 80 and my gas 50 to 60 even though i advised them and sent them my bills in the november to prove my payments went up but i never recieved anything back from them.
they said the trust deed was extended to five years because of my income, and that it was extended to the term to increase the likley hood of the creditors acceptance. Yet i have saw lots of people here with much more debt than myself yet on a three year one. I know everyone different but if i owed 13 thousand and my creditors only get 2000 of the 10000 over 5 years into a trust deed how is this benefiting the creditor. It is not its benefiting the TD Company.
Have we named and shamed this company? As much as thats maybe not what the forum is about this bunch of clowns should be avoided by anyone with debt worries as they have given massively incorrect advice and continue to do nothing but threaten a forum member in a pathetic attempt to continue to take money from them.
Unbelieveable,to say the least.
Companies like the one Reidy has used should be forced out of the industry. How many others like Reidy are paying this lot vast sums of money when they dont need to????

Thank you for your response mark, i sent you an email back in regards to a few things. Take your time on your response i know your so busy with your own clients and own cases and i appreicate you taking the time out of your busy schedule to have to deal with my situation. I hate to feel like such a burden to you, but i think if it wasn't for the advise from yourself and Td site i would be very emotional mess right about now. so its much appreciated.
Paul i can certainly say i would defently not wish this on my worst enemy. I take my blame for the mess i am in too i must have had guillable tattooed on my forehead and the fact of i was still grieving for the loss of my father and trying to deal with debts coming out my ears i added my own fault in it all and should have looked at things more clearly, thats my own guilt from it all for not being more vigilant in the situation. but after reading what i read this morning i went from upset to being totally livid the more i read, all these little mistakes add's upto one big mess. A mess i am now having to deal with, they send me there legal jardon and there legal explinations thinking i will bow down and play nice and restart my payments. I know i am at fault as well as this company but i refuse to recieve bully boy tactics.

Thank you mark for all your support so far, you have gone out of your way and basically above and beyond helping me than i ever imagined. The same goes for the trust deed site advisors, i really appreciate every part of your support in this matter.
I am preparing a second letter to be sent back to kpmg in response to the letter i recieved from them this morning highlighting every point in the letter i believe is relevant and incorrect. I also will be asking them AGAIN for the payment details of how they came to light of a payment of 650+ to the third party totemic ltd (Payplan the free debt company)and a breakdown of what work they were paid for and at the rate it was paid for. As this was not explained in the letter apart from a small paragraph confirming payplan is part of totemic ltd and no other additional information even though i requested it in writing.
Keep fighting Reidy,the attitude of your company stinks but I do wonder if its coming from the top or someone much lower down the management structure there.
As for court action I think you know yourself who would win if it did go to court and there is no way the company you went with will want to lose in such a public manner.

There would be absolutely no grounds for court action, unless Reidy took them to court.
I was involved as expert witness in a case against KPMG very recently with almost identical circumstances where contribution was sought from Job Seekers Allowance. Incredible.

In answer to your question paul the signature on the letter was an unrecognisble scribble but printed underneath is the name of my trustee. Yet on the front the contact information of the main letter is someone else in kpmg office whos name i do recognise as ive dealt with her before. I remember the name as i had to forward some of the letter i recieved to her when creditors began to sell my debts on.
My letter is nearly ready to go i have few significant points i had to explain in detail from the information they sent me in the letter. so the letter has came out longer than expected. But i wanted to make everything clear from my point of view. I will be posting it tomorrow so we'll see what happens from this point on with Kpmg.
In answer to your question paul If it really comes to it and if i'm truthfull the way i feel if it continued i would look into court action. Even though i am not sure where to start if this ever comes to light, but thats just a long way ahead because me and my partner had a long discussion about this all yesterday and i feel if they can do this too myself who else out there have they done this too. This company is disgracing what a trust deed is about and all other companies out there who do there job propeley and who are reputable and give the correct advise. Why should they be tarred with the wrong brush because of one company. As i said this is a long way off but if push came to shove yes i think i would persue it if it came to it.

I really feel for you and I can tell you're so stressed out by this situation. It would certainly seem that you're been given crap advice by a company which is supposed to be one of the better ones. My PTD is with kpmg but my experience is so different from yours. They've been really good with me - my only complaint would be the speed of their responses to my queries. And their astronomical fees I guess. But it's a small price to pay for the relief I currently feel.
I hope everything works out for you and you do get your discharge. Clearly KPMG are not the right company for you.

I totally understand where you are coming from i did a little reasearch on the matter as it has escolated and have read up on people having so many different experiences with the kpmg some with excellent experience and some not so much, but recently i have unfortunetly as well read of other people in the same situation as my self (Benefit based) with identical circumstances. Its such a shame too considering what AIB States that no income should be sought from those on benefits. People like myself seek for advice when we get ourself into such a bad financial state and we take the advice assuming at the time we recieve it to be correct and go into trust deeds only to find out through time it should not have been a option for us. The letter i recieved yesterday was basically them saying to me i was the one whom persued the trust deed but as i said i went by the advise i did not bully them and say oh put me in this trust deed. They are a company who know better they deal with this day in and day out. i thought i was doing the right thing even though i take blame for it too as i was not in right frame of mind due to grief and with debts coming out my ears. i was given the raw end of the deal and now i have to deal with the mess.

As pammy1969 says people do sometimes have different experiences...even with the same firm, but it is not good practice to put people into Trust Deeds whose sole income is benefits, especially to make it last for 4-5 years.
I have to say I am shocked that they have not back tracked. You sound stronger than ever which is great, I know Mark has been agreat support to you which has certainly helped. Don't give up!
