Got an email yesterday from the IPA , who informed me that my Trustee had not responded to the 28 day deadline they had set .
However they told me that after 5 years of threating a act of reduction due to him alleging a gratious alienation , he would not be taking such action against me after getting legal advice on the matter .
In 2009 I expected to be discharged having paid my half share of equity in full , he also took another 18k from the re mortgage , 1ok from the sale of my wine cellar , 3k in payments , 14k in PPI refunds . Plus I spent 4k in legal fees asking him to go to court to prove his allegations and settle things once and for all .
Given for 5 years he never proved his allegations and used the threat of such to draw huge fees over that time period , now he had decided not to take any action how can he justify 5 extra years of keeping me in a deed and drawing fee's ?.
Because of this I have been stuck in a interest only mortgage over that time period , I feel justified in taking action against him for 5 years of interest only repayments due to his in action and empty threats , those payments amount to 39.6 k alone . So given that and the other money taken from me amounts to 84.6 k !!!!!!!!!!! , which just about explains his fee's .
Any comments and advice as to how to nail him for being in such a situation would be helpful , if I added on compensation for harassment and the severe impact this has had on my health , never mind my marriage break up , topped up with interest I am sure I could pay off my mortgage with it .[^]

I'm glad to hear that the threat of that action has now gone.
I don't see helping to "nail" people as part of my remit here, but I do hope this moves towards an outcome that you consider to be just.
This guy makes trustees look bad. Its a good job he is not an example of what most trustees are like. I really wonder how many more people he has hanging on in trust deeds earning huge fees for him and his company. I know the rules have now changed and as far as I am aware this kind of excessive charging can't happen. According to the A in B website he still appears to have a huge number of " clients " locked into deeds lasting much longer than three years. Maybe unfortunately most of those Clients have not found this site to be able to realise what he is doing. I certainly did not realise till I found and joined here last year.
I don't have any answers about how to deal with him. His professional body should deal with him or risk looking almost as bad as he does.

Sounds like the kind of question you need to direct to a solicitor rather than the forum. There's always the risk of throwing good money after bad when considering legal action so you would need to be pretty confident of your legal grounds, which can unfortunately often be very different from moral ones!
Thanks for your input Kevin , sometimes my anger can affect my judgement , guess I will wait until the end of this week to hear back from the IPA now that he did bother to properly reply to them over a period of 9 months . Hopefully the AIB audit will provide further enlightenment !! .
Sorry that should have be did not reply to the AIB . Spoke with the AIB a few minutes ago and they decided to go to his offices today to finish its audit , because of the time delay and AIB investigation stay tuned folks .
I wish those who are meant to be taking care of things , look at e mails , just been informed he did send a reply bang on the 5pm deadline on Friday .

Well my Trustee , yer tea's oot indeed regarding your fees , will update the forum again soon , off to dance naked in the rain along Princess street and phone my trustees office and say nah nah de nah ha !!!!!!!!!! . Pass the beer .
All I can say for now is yet again his fees have been reduced by the AIB , how does he keep getting away with constantly over charging ??.
Once is a mistake the second time is a choice .
Roughly a 30% reduction in his fees , clear proof that myself and others have been ripped off .
As a wild guess, there will be the usual mutterings of this will be challenged ( although there are no legal grounds to challenge ) until the fees build up to the point that the decision not to challenge equal the 30% reduction.
Call me cynical!

Just what I was thinking Mark , however my thoughts are also with tonyd today and a positive out come for him , if my Trustee starts his bovine waste , more than happy to get his fees audited again .
thanks for the thoughts pinalta. And no Mark your not being cynical. The guy is too predictable. My final creditors meeting was this morning so lets see how keen he is to get things sorted and lets hope for a positive ending. And hoping for the same for you pinalta. Its been a long long road!
