I love my postman!

He just dropped my mail through the door and guess what i got a letter from KPMG!!!! [:D][:D][:D][:D][:D][:D][:D][:D][:D][:D]

Started off with a slight dissaproval.... i refer to previous correspondence of the above and am dissapointed you have not reinstated your contribution payments.

then lots of paragraphs

then the words i wanted to read!

It is now my intention to take steps to terminate your trust deed! wooohooooooooooooooooooooooo!

No expected date for final correspondence but says if i want to appeal against it i can at sherriff court within 14days of the date of the letter. (No thank you)[:D][:D][:D][:D]

Hopefully if all goes well you will be getting rid of my constent whining lol

Thank you for all the help everyone i can finally see an end to this mess.

I'm slightly concerned about the fact that your (soon to be ex) trustee has said that he/she is "disappointed you have not reinstated your contribution payments". I hope that the "lots of paragraphs" do not contain further insinuations that you are the person who is at fault in this situation...

Personally, I'd be tempted to write back, thanking them for their letter, and pointing that they are aware of your view that you were badly advised by them at the outset.

I'd also be tempted to mention that, following on from that bad advice, you have been unable to maintain the contribution payments which they set at an unrealistic level, and which are taken entirely from benefits (which goes against the guidance set out by the Accountant in Bankruptcy).

And, being me [:)], I'd finish off with a flourish - thanking them for letting you know my rights of appeal, but reminding them that you have been asking them to terminate your trust deed since...., so would not wish to delay that process further by appealing to the Sheriff [8D]

At the bottom of your letter, underneath your signature, put "cc: ICAS" (or whoever you have complained to). And then send them a copy of your trustee's letter, and your reply.

I know it seems like a lot of work, when your trustee is finally "taking steps" to do what you want him to do. But, personally, I'd not be very happy by the suggestion that the trustee is a poor wee soul who is looking to terminate the trust deed because you're at fault!

From someone that works in compliance and Trustee complaints (and taking an objective view)

- for your complaint to have any merit- you should formally make one and mark it for the attention of your Trustee listing all your concerns. He / She must have a chance to review the facts of your case and respond formally.

If a response is not received, you would follow this up with another one.

If you receive a response and are not happy with the contents then at the point - you should notify his professional body but please bear in mind the nature of your complaint

If a complaint is received outwith this protocol then the professional body is likley to conclude that the Trustee was not given the opportunity to respond to the complaint and would proceed to close it regardless of your nature of your complaint.

Again, this is simply a general rule of thumb in which i hope the Trust Deed Experts would agree on the procedure to complain

Ive removed my posts as i do not come here to be belittled by so called said company workers. i came for advice not critisim.

But i would like to state a fact I know the rules of procedure and have done since day one to which i always asked for specialist advice before proceeding. So dont just assume i am jumping in head first and sent icas a complaint before allowing the said trustee various occasions to respond to my original requests and my concerns. i have been having to deal with this since january.

I also know for a fact BPM45DO that kpmg as a business practice have there own procedure to follow, yet they have not followed protocol despite being asked for there complaint procedure on two occasions and addressing my concern properly and providing me with the items i requested. All letter have always been addressed to my trustee and i have all correspondences from the said trustee.

I don't think bpm45d0 intended to criticise you, but some of his posts on your threads have appeared to be pretty clumsy and I can understand why you've read them the way that you have.

bpm45d0... perhaps you could reassure Reidy1982 on this?
I'd also ask you to be careful and thoughtful in terms of your posting style in the forum please if you choose to carry on adding information and your thoughts.
