Valuation on property at end of trust deed?``

Hi, really hope you can help me as this is making me ill. I have just received a letter from my trustee teling me that I ave completed the conrtibutions to my trust deed. But he is also saying that he has had a valuation done on my house as to what the value was when I took out the trust deed in October 2005, and is saying that there was ?ú13,000 equity which he wants before he will remove the charge on my house. For starters there is no way that my house was worth ?ú42,000 exactly two years after I paid ?ú31,000 for it, I have the prices identical houses to mine sold for that year and the most was ?ú35,000 and that house had had work done to it. Also, no one came to my house to value it, nor even phoned me to ask about it. I have the original survey report which sataes there are a number of jobs to be done to bring the house up to standard, which have not been done even now because of lack of money. Also, if there was ?ú!3,000 equity in it at the time, this was more than half of my debt, therefore I would assume that they should have told me to remortgage and not enter into a trust deed, if I had done this I could have paid off the debts to half the companies, and then paid the rest off in full by meeting monthly payments.

I am very worried about this, I live in te house with my husband and five year old and two year old, but the house is in my name only.

What can I do about this? He wants how I plan to give him the money in writing within 14 days.

I was paying ?ú150 per month until this month in contributions.

Hi Kerry

I think, first things first, you need to ask for sight of the valuation to see on what basis it was valued at that level. On receipt of the valuation, please let either Kevin or myself have sight of it to advise further.

Ok, I'll email them now and ask for a copy to be sent to me. Should I also be getting in touch with the CAB? He also emailed me a few months ago and said that he would only be looking for ?ú500 in respect of my property, now he seems to have forgoten that. when his agent came to my house to discuss the trust deed before I signed it I asked him about what happened with any equity, although I was sure I had none as I also had fees added to my mortgage, anf he just said that there were ways round it that would be sorted later.

which firm is it and when you say Agent, did you ever actually meet the IP or a member of his staff before signing. Also, is the Trust Deed 4 years old?

Re the CAB, I'm not sure they would get involved if you've signed a Trust Deed.

Hi Kerry,

Were you referred to this firm by the CAB in the first place? If so, I would say it may be worth contacting the CAB to discuss it with them. They may have some other paperwork regarding what was discussed at the time and more importantly they may be willing to contact your trustee on your behalf about this problem. In my experience having worked in a CAB, IPs are more willing to negotiate or back down from this kind of position if they know the CAB is involved - after all they are a source of work for IPs and can easily recommend that their clients go elsewhere instead.

I had contacted CAB before, but they didn;t give me the name of the IP I am with, my friend had a trust deed with the same company, and gave me the details. Difference was she was not a property owner.

Can I still ask CAB for help even though they didn't put me in touch with the company? I also emailed them yesterday to ask for a copy of the valuation and as yet have heard nothing back. From past experiences if I phone them I will just get a receptionist telling me that no one is available to talk to me and she will pass on a message, to which I so far have not had any replies

Mark, yes as far as I am aware it was one of his collegues that came to my house to fill in paperwork, but not the IP himself. The company is K G Le May, based in glasgow I think. I will check the address when I get a chance and post back.

I was wondering if the CAB could advise me as to the options I have available for raising money if the IP will not back down, however I feel that they advised me to sign a trust deed when the equity that they are saying I had would have meant that a remortgage would have meant that I could have cleared all my debts without help, and the companies I was owe money to would have eventually been paid in full. The trust deed has run for 4 years, as I got a payment break to replace the boiler in my home, and also when I had another baby

Hi Kerry, if you email me contact details, I'll try to look into this for you.

I'm not sure CAB will assist as they generally don't if you're already in a Trust Deed.

Sorry, but I am really worried. I have just read on another site that I can be forced to sell my house to pay equity. I share the house with my husband, 2 year old daughter and 5 year old son. but the house and mortgage are in my name only. I am scared that my kids will end up homeless. My husband can't help with raising the money as he has a lot of debts too that he is trying to pay off. Do you know if i can take out a secured loan with my mortgage company? I don't think i can remortgage as apart from the trust deed i am self employed only earning ?ú50 per week average

I have emailed twice and phoned once, but not got anything. When i phoned it was the usual story, leave a message and he will call you back. That was 23rd December and I am still waiting.
