Hi,

I'm in a protected trust deed which ends in July this year. It's not been easy as I'm on my own with only one source of income but there is a miniscule light at the end of a very long tunnel.

However, I managed to get myself into a right mess towards the end of 2013. I haven't told any of my family about my trust deed. My dad's mortgage had came to an end but for the past 10 years or so he had only been paying the interest due to ill health.

At the end of the mortgage the mortgage provider want the balance of £28,000. The only option open to my dad was to pay this off or sell the house. The latter wasn't an option, it's his home. So one of my brothers took out a personal loan but we had to pull together £4,000 between us to pay the £28,000.

I had asked for a payment holiday from the trust deed but was denied this. In fact, at any time I have asked for a break for even a month the answer has been no. I pay £250 per month for PTD.

Anyway, I stupidly took out a payday loan in order to contribute to my dad's situation rather than admit to my situation.

I tried to come to an arrangement for repayment for the payday loan which the lender declined. Instead it went to Sheriff Court and I got a time to pay order in November 2013. I was to pay £30 per month but even this was a struggle and I couldn't make payments.

The lender emailed me with options to resolve and I opted to pay £30 per month again but they wanted the arrears of £120 first before accepting this.

Again, I couldn't afford this and I have now came home to a notice from Sheriff Officers looking for payment of £1,000+ within 14 days.

What can I do...have I ruined all the work of paying my trust deed each month with only a few months left?

I have no idea where to turn or what to do about the notice.

Any advice welcome. Even chastising, how stupid I have been 🙁

I hope this does not sound like a cop out but I would say go to Citizens Advice and see if there is any way they can buy you some time until you complete your Trust Deed. Every one of us who have been through a TD knows how difficult it is and you have done really well to get this far despite the obstacles you have faced.
July is not far away and once complete those extra pounds you have will make a world of difference to you.

Hi Lynn.

You obviously have a family that pulls together in times of need.

Might it be time to open up to your family to see if anyone can lend you a hand now?

Thanks for the responses. I've taken Friday off work and will go along to CAB.

TDA - I wish it was that simple. It can be a bit of a one way family. I wasn't brought up with them. My parents divorced when I was very young and I was brought up with my mum.

My dad has a new wife and 4 children with her. I didn't really start contact with them until I was in my 20s and have always felt a bit of an outsider. However, I couldn't see my dad lose his home. He doesn't have money that I could borrow.

Asking my half brothers and sister is not an option as they have never really accepted me. It's only when something big happens that I am involved.

Don't get me wrong, they are lovely people but I definitely can't go to them. One brother would take particular satisfaction at my predicament.

I will seek money advice and hope that some kind of arrangement can be made.

In that case getting some help and support from Citizens Advice is very sensible.

I think it is a case of persuading the payday loans company that it is not in their interests to go further with enforcement which would potentially lead to the failure of your trust deed. If that happened then they would join the queue with all of your other creditors. However, if they are flexible enough to accept small payments until your Trust Deed is successfully completed then they should get paid off at a much quicker rate.

Hopefully a Money Adviser at a free advice agency would be able to put this argument forward for you. You may find that your first appointment is with a generalist adviser if you just drop in. You may be better to call first and try and get an appointment with a debt specialist, as the situation is an emergency given the legal action already taken. You could be at risk of having your part of your wages or bank account arrested if something isn't sorted out quickly.

Hopefully the CAB will be able to help you. They may get the Sheriff Officers to accept a token payment (£1) until your TD finishes and then you can pay it off with a larger sum each month, it's not like you don't want to pay it, the fact is you can't!

I had a debt that wasn't included in my TD and I am paying £1 a month until my TD finishes then will clear that. Hope you get some good news.

The sensible solution would be for the Trustee to allow somew leeway and reduce the TD payments, then extend the period until matters are resolved.

But then again, when did sense prevail in these things!

The payday lender is going to accept a small amount for first few months until my trust deed finishes, then I'll increase it and get it paid off as quickly as possible.
