Trying to Clear Up Defaults

Hi All,

I am looking for some advice please. I completed my TD in October 2014 and received my discharge certificate in December 2014. I have recently been checking my credit reports on both Noodle and Experian and whilst I have noticed that some of my creditors have my account as satisfied or partially satisfied and re-set the balance to £0 there are another 3 creditors on my file who still have me as defaulting each month, right up to this month and still have the balances as when I originally entered into my TD. Could somebody please advise if this is correct and they are within their rights to still be showing me as defaulting every month even though I have now completed my TD. Should they at least have me as satisfied or partially satisfied and should the balance be returned to £0 as when I look at my credit report on Experian it shows me as having a very high credit amount being used when this is most certainly not the case, but when I add up the balances of these 3 creditors that amounts to the outstanding credit Experian is showing me to be using.

Any help would be most appreciated.

Hi notlongnow.

No, their reporting to credit reference agencies needs to be in line with the reality of the situation.

The reality is that you no longer owe the money and, therefore, cannot be defaulting any longer.

It's a case of contacting the creditors and requiring them to put right their errors.

Thanks TD Assistant, can you advise the best way for me to go about this. Should my balance be £0 and should it read satisfied or partially satisfied.

Also on my Experian report it gives me the creditors details, however one of them is Barclaycard and it gives no details on how to contact them, would anyone know their details from having previous dealings with them.

Thank you very much TD Assistant this article is very helpful, I will now get some letters drafted up and copies of my discharge certificate and get them sent off. I appreciate I may need to carry this out several times before I get anywhere with them but again should they set my balance to £0.

You don't have to write notlongnow.

It might be quicker and cheaper to call them.

They might ask - but equally I think from your posting history that your details will remain on the Register of Insolvencies?

That's a public information resource that you can direct them to. If they don't want to you might choose to consider whether a complaint is necessary (to get someone a bit more informed and proactive to take a look at the situation).

Up to you though - there's arguments in favour of handling things in writing also. Just seems time-consuming and slow though.

Hi notlongnow.

I would suggest, as TDA said, contact them by telephone first. If they ask for a copy of the Form5, send it immediately after recorded delivery to the person you spoke with (or the person they ask you to send it to). I found writing fruitless and it had to be followed up with telephone calls and then I would fax or e-mail a scanned copy of the document.
