I really can't understand why this notice should be necessary in a voluntary surrender. If it is a notice directed at you to say that you must remove your possessions, then what is stopping you taking it down as soon as they put it up?
Kevin
As I understand it, the notice referred to is posted by the lender or their appointed agent, in the front window, facing the public. This is done after possession /lock changes have taken place, the occupier no longer there to remove it. It's a legal requirement to allow anyone with belongings within to obtain the correct contact details to arrange their removal.
I dont see why that would ne necessary if it was a voluntary repossession. I have never had a client where a poster has been put in the window, it's ridiculous.
Shona is not currently posting in the Trust-Deed.co.uk forum.
Yep that's how it was explained to us Pamjo. My husband asked why it was still needed when it is voluntary and she just said it's a legal requirement.
It's absolutely mortifying and has almost put me off doing it altogether but I know for the kids health i'm going to need to do it, i'm so ashamed though 🙁
Hi Trustdeed1
I'm so sorry to hear of all the extra stress this is causing you! I agree with Shona - it is ridiculous!
But - you are moving on to bigger and better things and if anyone does have the guts to ask to your face you can tell them the truth that you are moving to a better home for your family's health.
Most folk are so self involved the probably won't pay the signs any notice - either than or you pan your windaes in! JOKE!
lol thanks, you made me laugh hehe
As with many things, if you don't ask, the answer's a definite no...Could you write and ask if this can be avoided since you are giving possession as opposed to being removed and you will remove all items in a timely manner. Surely it will be obvious in the empty damp house left behind that nothing of value's been forgotten. maybe companies anmd departments just get into habits and need a prompt to see that the actual legal need for it doesn't exist?
Thanks Pamjo, my husband did call back and ask if there was any way this could be avoided but he was told no it was a legal requirement. On the day they come to change the locks he is going to ask them not to put the nbotice up and see what they say but not holding out much hope 🙁
