Trustee discharge and PPI

[:(!] been discharged from trust deed since June 2012. A few weeks ago I received a form from the Halifax about PPI. Another letter received this week to say I would have gotten a payment of nearly ยฃ3000 if I had not been in a debt management programme!! When I phoned to tell them their records were incorrect, they duly said they would look into it. I received a phone call from them today and was told that I was not due a penny because the trustee had a mandate!?
2 years later and it still won't go away is this really correct - I have the discharge certificate, will this ever go away!?

Welcome to the forum Gilly.

Has your trustee been discharged also? You can check online on the Register of Insolvencies.

If not they may have "remained in office" to collect the PPI to help repay more to your creditors.

The alternative would be to refuse you your discharge until they'd finished that work.

The potential to reclaim PPI was an asset that vested in your trustee when you signed your trust deed.

I have tried to check the online register today, but am just getting an error message. How long can they "remain in office" for? I understand that PPI is an asset , but I have had ppi paid to me in the last year with no mention of the trust deed?

That technical issue has also been reported by another member Gilly. I'm sure they're working hard to fix it so I'd suggest that you continue to check the site.

There's no time limit prior to a trustee seeking their discharge. They'll do it when their work is done.

It might turn out that your trustee has been discharged in which case you'll be able to push back against Halifax.

Got conformation today that the trustee was discharged in November 2013, the Halifax are refusing to allow me to send them a copy of the discharge cert, and the trustee knows nothing about any payment offered to them? Will just keep trying I guess and there's always the FSO I suppose.

Hi Gilly.

The Financial Ombudsman Service is definitely the place to go if your PPI complaint isn't resolved to your satisfaction by Halifax.

They (FOS) will make a decision to bring the whole thing to a conclusion one way or the other.

Unfortunately I don't think that process is currently working very quickly though.

Keep at them. It sounds like the usual call center nightmare where nobody will make a decision. As TDA says, threaten them with the FOS if they don't resolve it.

Well the Halifax have said they would cancel the payment to the trustee, and re issue the payment to me, and low and behold - another call from Halifax to say they could not issue payment as I was still in a debt management programme!! Still will not let me send proof, and can't get passed the 1st person I speak to in the call centre at anytime!!!! So I think enough is enough, it's time to call in the FOS. I know this might be a prolonged process but it looks like the only thing to do at this stage!?
