My trust deed was paid up on Jan 2nd 2015 but TurnDebtAround and Invocas (same company) decided not to discharge them selves, although they did not apply for PPI refunds until near the end of my trust deed, and on April 10th BOS refunded £21,798 of which between them they took nearly £9,000 stating that they had kept the trust deed open hoping to get some refunds although ALL the work form filling , telephone interviews were done by me. As of today's date I have still not received my trust deed discharge - What a rip off and plain unadulterated GREED.They are obviously waiting to see if they can get their grubby hands on more money.
Welcome to the forum BobMac.
All firms are required by their regulators to investigate whether PPI claims can raise money to help repay the creditors of their clients.
All firms will not discharge themselves until that process is finished, though they are often able to discharge their client while this work takes place (provided all other obligations are complete).
Without commenting on the level of fees involved in the PPI claim and/or trust deed in this instance, this is standard work that needs to be done.
Can I ask whether your creditors stand to be fully repaid the amount that is/was owed to them?
They will just about be cleared but why am I waiting for my discharge? and how long does this go on for.
You'll need to ask your rustee as to why you are waiting for your discharge, Bobmac. As Trust Deed Assistant said, there is usually nothing to stop them issuing your discharge (form 5) but staying in office themselves to deal with outstanding PPI claims.
When did you sign your Protected Trust Deed?
I signed it in December 2011 to commence 36 payments on January 2nd 2012 the payments ended on January 2nd 2015 and I have sked 4 times on telephone where my discharge papers are and am told each time the letter will be in the post this week - As of today 23rd June still not received any paperwork ) was told on the phone that they had reopened my trust deed so they could collect fees from my PPI refund,
Hi BobMac.
We can only really advise you to keep pressing for your discharge directly with the firm concerned.
It's usually possible to discharge you while carrying on the PPI work that they need to do.
I have today 26th June received my Form 5 discharge which was dated 9th April 2015 but Invocas had not bothered sending it me - no apology received. All my PPI claims have been dealt with and all creditors confirm that the claim files are now closed . I have not taken out PPI since 1998 so there is no more money to claw back so why does my Trustee insist on staying 'in Office' ?
That will be because they haven't finished their work on your case yet BobMac. There are other processes as well as PPI.
The lack of trustee discharge really need not have any negative consequences for you though. It's your discharge that's important.
I sent an appeal to Financial Ombudsman about PPI claims being denied as TDA and Invocas were going to nothing about it "not our job to appeal" The FO upheld my claim and now BOS have offered me £7,500. As neither of the above companies did any work in winning this appeal can they really justify taking any fees. It just seem a big gravy train for them In total they have taken £12,500 in fees to clear a debt of £22,200
Hi BobMac
I don't think your trustee will be seeking payment for any work carried out by you. The normal process will be for the funds to be paid to the trustee and for the trustee to make payment of a final dividend payment to your creditors. On conclusion of this, they should then be in a position to seek their own discharge.

Help !! Need some questions answered regarding PPI and trust deed ....
Right my parents entered a trust deed in 2009 and finishe nov 2012. They recieved a discharge letter then discharging them from the trust deed. Then on 4th fen 2015 recieved a letter from the trustee discharge themselves from the trust deed also .
On June the 6th my parents were awarded a PPI claim .
This was sent to the trust deed company and they are now saying they are using it to reopen the trust deed . Can they do this even though both my parents and trustee are discharged from the trust deed ?
Also if the PPI was from a joint account in both parents names and the trust deed only being in my fathers name , can they take the full 100% or should 50% be my mothers compensation? She was made bankrupt so there for no trust deed was in place ?
Please help
C.a.P
Thank you Mark but this is TurnDebtAround and Invocas we are talking about and they have claimed fees at every opportunity to rake in as much as they can It has cost me (so far) £12,500 in fees to clear a £22,200 debt !!
Hi BobMac
If you check the posts from Pinalta, he requested that the Trustee's fees be audited by the AIB. That way they will carry out a review of the work actually done against the fees charged. The AIB has the power to reduce fees if they think these are too high.
