Hi all well it is not looking good for my trust deed going protected, there were three objections on the final day. The exact amount I owe is ?ú55,958.04 to a total of eight creditors.

On the ones that objected I owe ?ú9049.23 ?ú9174.69 & ?ú839.00 giving the added up debt of ?ú19062.92

1/3 of my total debt comes to ?ú18652.68 which means it may not go protected for the diff of ?ú410.24

IÔÇÖm gutted but my trustee is trying to get the smaller one overturned? I will have to wait until Monday to find out if this will happen. What are the chances of getting an objection overturned or changed?

I donÔÇÖt really want to go down the road of bankruptcy but may not have the choice, can any of the experts give me some advice on what will be involved if IÔÇÖm made bankrupt.

Hi toomuchdebt

Did your Trustee advise who objected and the reason for the objection?

Mark

Hi Mark
Egg,Barclay card & littlewoods egg & barclay objected on my food bills which are ?ú500 a month they only accept ?ú450 or something like that, there was a couple of other things like child activities and phone there was a difference of ?ú140 in total. I dont know what littlewoods objected on but my trustee was trying to contact them to find this out, I`m still waiting to hear from my trustee for the final verdict.

Hi ttomuchdebt, sorry to hear your problems, can I just point something else out to you. I have been given ?ú450 per month for food bills. However, if you multiply 12 times 450, then divide it into 52 weeks, I only actually get ?ú103 per week for food etc. This may seem a small point, but watch that figures given by your trustee are what they really seem, ie multiply monthy cost by 12months then divide into weeks. Appears Scottish IP's consider all months to have only 28 days, and when you're left trying to balance your cash it'sno laughing matter, all the best to you and your family.

Hi
Just had great news from my trustee, my trust deed is going protected.
One of the creditors objected on the fees but my trustee altered the fees and everything is ok now, I`m so happy I know it will be a long three years but this whole experience has made me realise that I will never get myself into this situation again.

Thanks to everyone for their kind words and support & advice, I will keep the forum updated on my progress.

Hi toomuchdebt,

That's FANTASTIC.

I know you must have had a very worrying few days and I'm so glad that everything has now come together for you.

Nice one toomuchdebt - I'm very pleased it has turned out well for you.

It's interesting that the trustee reduced their fees after the objections - hopefully it restores some faith that there are mechanisms at work to ensure that insolvency practitioners cannot just get away with charging whatever they like. However, it is a shame that you've been put through the wringer over the last couple of days as a result!

I guess you'll have to change your forum name now....maybe nomoredebt instead!

I know both Kevin and Mark had concerns about the fee levels mentioned for this case and it's a shame to see that it ultimately threatened the acceptance of the arrangement (albeit with a happy ending).

I guess this has to be another area that people should consider when they choose a firm to represent them.
