Hi this is my first post. I was looking for some advice on my trust deed.I signed in February 2012 and paid my final payment in February 2015(6months ago). I received a letter from knightsbridge insolvency saying I had completed my trust deed and would receive my discharge letter in due course. I have phoned them numerous times regarding my form 5 but they have said they are still dealing with paperwork. I phoned again this morning and they said that 'a few creditors are dragging there feet on the final settlement'. I was just wondering if anyone else had this problem or had trouble getting thier discharge from knightsbridge. I would really like to be formally discharged and be able to move on, feel like the last six months since I have completed my trust deed have felt longer than my 3 year trust deed. Thanks

I'm not entirely sure what 'a few creditors are dragging there feet on the final settlement' means as it makes no sense. To be honest it sounds like standard call centre response.
Once finalised, the trustee takes a final fee and the balance is paid by final dividend to creditors. This is probably 2 hours work max. Creditors are unable to drag their feet!
I think your only option is to ask for specific & clear reasons for the delay and advise if these are not provided then you will refer matters to their governing body.

I did think this was strange as I knew my trust deed was a straight forward one as I do not own property etc and no PPI involved.
They also advised me that my phone call would be noted and to give it a couple of weeks till the chased up the creditors. I don't like to keep chasing people up but it is starting to annoy me now.

A question for Mark/Kevin/David -
I guess every firm will put in place their own procedures about bringing trust deeds to their conclusion. However - in an instance such as this one couldn't this work carry on being done after the client has been discharged (prior to the trustee discharging themselves)?
It could, Trust Deed Assistant, and that is certainly how we would do it. There is no need to keep people waiting for their own discharge while the closure admin is sorted out - once they have completed their obligations then they can be discharged very quickly.
Unfortunately it seems that not all firms operate this way - it baffles me why not to be honest. Surely it is just common decency when people have been waiting for 3 or 4 years to move on with their lives.

Like Kevin and Mark have said there really isn't any reason to keep someone waiting for their discharge after their have completed all of their obligations. A Trustee can remain in office to chase up any outstanding creditors claims.
I don't think it's fair if someone is still tied to a Trust Deed with the risk that if the inherited or acquired an asset then they could effectively lose this long after completing all of their obligations.
To actually complete the Form 5 and deal with this takes 30 minutes if that.
My firm upon completion of payments and obligations will discharge an individual within a couple of weeks.
The best advice I can give you Fionak4 is to keep on at your Trustee on a regular basis form our Form 5. I'm sure if you shout loud enough you will receive it.

Keep at them Fiona it's the only way! Don't be afraid to call on a daily/weekly basis.

On my form 5 that i received it said the trustee was staying on to investigate into any PPI.. Fine with me.. as long i was discharged. ๐ Keep on them Fiona ๐
My trust deed was pretty straightforward.. No PPI so don't understand why would take so long. Thanks Amerififer I will do.:-)
