Trust deed and tax rebate ?

I phoned the tax office today and they said that they havent got back to me because theyv been in contact with a 3rd party about my finances, im in a trust deed what does this mean ? Will they contact my emplyer about this im panicking now, who does the tax rebate go to ? Help please ! Surely it would be paid to me and itd be my duty to hand it over ? Or part of it as obviously i was over paying tax at this time ? Its not much anout 150ยฃ .

Don't worry, HMRC won't disclose details of the Trust Deed to your employer.

It may well be that they've spoken to the trustee to see where the funds should be sent.

So does that mean that i wont get any of the tax i overpaid, even if it meant rhat for those months i was having to live of less than i should have ?

It depends on the stance taken by the Trustee.

Logic would say that it goes back to you though.

I would speak to your trustee about these funds as soon as possible, Bobbyfrankel. You might need to put your argument forward to them in order to see any of the rebate yourself.

Yes i will, all be it it was 6 months ago, and i forced the rebate it wasnt automatic, but my payment was still made at the end of the month to the td, i just had to scrape by, i was hocked when hmrc told me that the payment was going through a 3rd party ? Legally can they just take this from me ?

We cannot provide legal advice. However your trustee may feel obligated to collect additional sums of money that come your way for the benefit of your creditors.

You'll want to put forward a case that this isn't additional money, just a refund of money that's already incorporated on the "income and expenditure" used to calculate your trust deed payment.
