My trust deed will conclude in October or November. I think.

My parents are asking if I will become their power of attorney as their health is beginning to decline.

I want to be certain before I take on this role that it does not have an impact on them that I am in a trust deed.

My parents do not know about my trust deed (nor do I want them to know). I want to be certain that me being in a trust deed and then taking on the power of attorney role does not compromise their financial status. That my trustee cannot claim my parents.

Please help.

Hi poorweeme

I don't see any eason why it should have any impact on your Trust Deed.

If you decide to proceed, I would advise your trustee, just so you have something on record.

Well I contacted my trustees today , to be informed that it is not possible to take on the power of attorney role whilst under a protected trust deed. This is apparently mentioned in the office of public guardian. This is a dilemma because I do not want to confess to my parents.

Come October I can take on the role but what do I do in the interim?

Is there anyone else in the family that could take on this role at the current time poorweeme until such time that you are in a position to take over?

Might be worth checking this out with the Office of the Public Guardian. I'm not saying that the person you spoke to is wrong, but is always worth checking. There are quite a few positions of responsibility like this where if sequestrated you are not allowed to undertake them, but the same doesn't always follow with a trust deed
