My company knew I had a TD during it one manager was always making digs about me not affording this that and the other.

Yesterday he called me in to see him, he is waiting for his to become protected and was asking me lots of questions.
Said he was sorry about the past remarks and how easy it was to find yourself in this position.

The thing is he has a holiday home in France and has not declared it to his trustee. He is hoping the won't be able to check this out. Is he correct I can't see how you can hide such an asset.
I do feel for him but come on, he could sell it and pay what he owes, he really does take the p@@@

Thankfully our paths don't cross often, not my department:-)
What do others think?

Completed 3yr TD Sept '12 discharged Sept '12. Trustee discharged Jan '13

Hi twizzle

He's playing a dangerous game. My advice is always to include everything, good or bad that way you don't have 3 years looking over your shoulder and to be honest with sufficient experience, the tell tale signs are fairly obvious that something has been excluded.

It's amazing what things get found out over the course of a three year period from creditors, bank statements, WOM etc.

Hi Twizzle,

It's disappointing to hear that a manager at your work resorted to making digs about your situation. You never know what is round the corner and for a whole range of reasons people can find themselves in financial difficulties and have to consider a formal solution to deal with their debts.

It's very risky not declaring everything at the initial meeting. Once someone has entered into a Trust Deed there is no going back and steps have to be taken to realise any assets.

You would be surprised at the different ways in which we can find out information regarding assets and things like that often come to light eventually as Mark has said.

A Sequestration I dealt with in the past had a ยฃ100,000 Ferrari. We couldn't find this and the person insisted they didn't have it and was generally being uncooperative with our investigations. We were advised that it was fitted with a tracking device so we contacted the tracking company and were provided with details of where the car was.

It's always best to be honest as an advisor can then give good advice on what the most suitable options are.

It's just outright dishonesty.

Not an especially good characteristic for someone with management responsibilities.

It sounds like he has a couple of unfortunate characteristics.

Attitudes like some to not declare assets impact on others who are upfront and want the trust deed to succeed. No wonder quite a few trustees are of a suspicious nature!!!

Ps none of the ones on here!!!

I felt terrible being in a TD let alone his little digs:-( He is a horrible man, thankfully he is not my boss.

He rents it out in the summer even listed on one of the rental sites with his name as contact. I think he will be found out like you guys say bank statements etc. Maybe land register I don't know all I know is our trustee looked at everything. Got to be something in his statements or credit cards leading to it.

Like you say 3 yrs is a long time to have to hide this from his trustee.

If you know who his trustee is, drop a copy of the advert to them and highlight his name. Assist karma in biting him in the arse. Personally, I'd have hit him to HR for making digs about my financial position. What a hideous little man!

Nothing left to discharge - everything's done and dusted!

How life twists and turns, I have had two promotions since I finished TD then on Friday I got a further one. I have worked hard to achieve this and deserve my promotions. I am now the same level as HIM. He called me asking to back him in meetings phah I asked him about his holiday house he said they still don't know about it laughing, he's selling it and will keep the money in his French bank account so they don't know.
He is really the most obnoxious dishonourable person I have ever met. As we are now very comfortable, it will be fun for me in meetings, knowing he can't do me any harm now.
Who knows what his Trustee will uncover but 3yrs is a long long time to hide an asset:-)

That's a pretty meteoric rise by the sounds of it twizzle - well done.

As far as your colleague goes, unfortunately there is a good chance that the trustee will never know about the holiday home unless they are tipped off.

Hi Twizzle,

That's really good news about the promotions and now being financially comfortable.

You just never know what could be round the corner and things seem to have turned full circle.
