hi ppl, 1st post.
in 2004 i setup a trust deed and after some difficult years i completed it in 2008 and have my completed and discharged letter.
in my letter its made award that i am discharged and that trust deed place will notify accountant in bankruptcy of there discharge.
now after 6 years i decided to try claim back ppi through various companies i had debt with. i was only successful with bank of scotland who offered me almost 10g. i was over the moon until i seen that they are sending it directly to my trust deed people.
1. i have had my discharge letter
2. i have been made aware that t/d place is discharged as well according to my letter.
3. i cant find my name anywhere on accountant in bankruptcy website at all.
4. what do you think my chances are of getting anything?.
ppiscotland are dealing with the whole case for me, im not really doing much but id be gutted if i and they didnt get anything from it even though i been discharged
Hi COOLCRAIG1975 and welcome to the forum.
When companies pay out PPI claims they check the insolvency registers and the information that they might hold internally about old insolvencies (perhaps because they were a creditor at the time).
They have to be careful, because if they pay you and then it turns out that you weren't discharged they might have to pay out again (to your trustee).
A risk averse approach for them might be to send it to your (former) trustee first. If they're no longer acting the chances are they'll return the money to the company that paid it out, or forward it to you.
Will you end up getting the money? Quite possibly you will in due course, though there are two things we've heard of that might get in the way or slow things up:
1 - Some banks, notably the RBS Group for example, seem to have taken a position that they can set-off a PPI repayment against debts that might have been included in a previous Scottish trust deed.
2 - We recently heard here in the forum of a trustee who appears to be looking into whether they can re-open an old trust deed to gather in PPI repayments that they missed when handling the case.

i did register but cant seem to find any info.
its just frustrating after all this time my trust deed place still being brought into the equation. they were brutal with me, even i was unemployed for 3/4 months they were still demanding money even though i had the insurance. bugs me if they get it

Any entry on the register is now removed a year after your trustee has been discharged. It sounds like that's why you're not on there.
It certainly doesn't sound like the money will end up with your trustee, though even if it did it would be for the benefit of your former creditors rather than them.
If it were me I'd contact my former trustee to confirm with them that they'll promptly notify the company paying out your PPI claim that they're no longer acting and therefore cannot accept the payment (or will forward the funds to you). I suppose you could also ask the claims company to do this.

been a week know and i thought i'd heard something.

5 mins after i post i got a call from my ppiscotland.
turns out i'm legally discharged and things are looking very good to receive the funds.
only thing is bank of scotland had already sent chq out to t/deed place. so its now in a legal claim to refund the chq which can take 28 days but other wise things are looking good.
I was awarded a PPI payment a year after I was discharged from my PTD, the credit card company sent the monies to my Trustee.... Fortunately for me my Trustee contacted me to let me know and they then transferred the money into my bank account as they had already discharged themselves..... So hopefully you'll be okay...

I cant believe so many people have gained so much from ppi. We never took any and were never miss sold any.

It isn't free money really though. The premiums were added to the loans so people are only getting back what they have paid out unwittingly, or were unfairly pushed into borrowing, in the first place.
I never even considered looking into it, but the PPI recovered for my TD was pretty successful.
hi people. sum how couldnt log in to my account COOLCRAIG1975.
so i set up and the password recovery didnt seem to do much in sending me an email so i had to create another account.
ppiscotland asked if i wanted to phone up INVOCAS to try speed up the process but i said id rather wait, i refuse to take anything to do with them ever again, even if it lets me wait a month for any money.
i'm hoping i will hear something before xmas
i have had official confirmation i am getting my ppi claim.
trust deed place have confirmed they no longer manage my account and a new chq has to be issued. only problem is not to sure when they will do it can take up to 2 weeks but im hoping wont be that long.
ppiscotland did everything for me. i believe the charge is 25% plus vat so im looking at paying out ยฃ3000, i realise its alot but i'm still well happy
