My working tax credits stopped in April 2012. I received a letter today, saying that my partner and I own over £200 on over payments, dated to April 2013. My TD started in March 2012. Will this be included in my debts with the TD, as if they are from April 2011 to April 2012, my TD started in March 2012? The TD is in my name only.

Hi Melissa

If the payments pre date the trust deed then your trustee should try & get them to submit a claim.

WTC overpayments will not normally be valid claims in the trust deed and HMRC will normally try to recover these from any future payments. However in my experience they may submit a claim and hopefully that would be the end of the matter.

Best refer it to your trustee.

I got one saying we owe them £81. I have always filled in forms accurately so have told them its their mistake. Lets see what happens next.
