While reading trust deed FAQ on this web site I discovered that student loans can not be included in a trust deed, has this recently changed or has this always been the case??
Invocas have included my student loans in my trust deed what do I do??

No, student loans are excluded.

Was it an "official" student loan or was it from a bank?

When does the loan date from?

Student loans used to be included, lisa1979, but this changed a few years ago.

Hello Mark,

I entered into a protected trust deed in 2007, it was an offical student loan not through a bank. I have to earn so much before i qualify to pay it back.

Where do I stand? What, if anything do I do?

Hi lisa1979.

I think you should perhaps seek some clarification from your trust deed provider.

It seems unlikely that this debt will be discharged from the information provided.

Best speak with your Trustee, however prior to April 08 they were included as debts, this was changed via the BAD Act in 2007 from memory making post April 08 student loans exempt as debts.

I believe that if you signed your trust deed prior to 1st April 2008 then your student loan should discharge along with your other debts, lisa. The legislation changed, but not retrospectively, so it will have only been trust deeds signed after that time that will not discharge student loans.

Your trustee should seek a claim from the Student Loans Company (if they haven't already) and pay them a dividend at the end of your trust deed. Any remaining balance should be written off by the Student Loans Company. Best course of action for you is probably to speak to your trustee and check that this is what they will be doing.
