hi looking for advice i entered trust deed in june 2007 had 36 monthly payments payments ended may 2010.didnt get dischsrge as they were waiting on ppi payments got them on feb 2012,still no discharge they are investigating into vat refunds this was march 2012,emailed today asked why no discharge yet,still investigating vat refund and could not give a time span on when it would be done,surely there must be a time span to do this what the hell is vat refund and why should this stop my discharge,its been almost 6 years i dont think its fair that my discharge is not released because of this,is there some governing body i can complain about this im getting sick of waiting please help any advice grateful
There was a different discharge process pre April 2008 unfortunately which generally winds up the trust deed & discharges the trustee and you. Post April 2008 you could be discharged with the trustee remaining in place to finalise PPI etc.
The position with the VAT is something completely out with your trustees control unfortunately, although this matter should be finalised very soon.
My advice would be to keep on top of them to ensure your trust deed is first for the VAT refund which will allow for the closure of the trust deed.

As unfortunate as it is the Trustee has a duty to carry out and if they do not do so they risk losin their license. They get monitored by their governing. Oxides on regular occasions and must not cut corners.
It seems you have simply been particularly unlucky in that at the time of your discharge PPI had to be looked in to and then HMRC would have approached the Trustee re the VAT. Like the PPI this may result in greater funds going to your creditor so must be investigated.
Keep in regular contact for updates. This will keep your case administrator on their toes!
