Solicitor check - help please

Hi

I wonder if anyone can help me, we have received a full mortgage offer and are in the final stages of completing a sale and purchase. It has been suggested that the solicitor will do a bankruptcy check and will be obliged to provide all information to the lender. We have not misled the lender or broker. However does anyone know where these checks will be carried out and how far back they go? We are no longer on the AIB register.

Any help greatly appreciated.

Are you selling a property and buying another?

The solicitor will not normally do any type of credit check. There is a requirement to check the Register of Inhibitions & Adjudications to ensure the sale/purchase gives clear title to the property. If you've been discharged & there's no inhibition registered, it should be fine.

The solicitor will have access to the Registers of Scotland online to check this.

Thank you for your help, we have checked the register and it shows our discharge it says Notice recalling notice by trustee under trust deed?! What would you think a solicitor will make of this?

Starting to panic that things are going to go wrong!

Hi Jambo

If you've been discharged it will be fine.

It is a requirement of the trustee to discharge the inhibition, so there will be no inhibition registered. That's the part which states the notice being recalled.
