I'm currently finalising a trust deed, but have just received a sherriff officers letter from one of my creditors. Will this affect my trust deed application and what can this creditor do regarding the letter i received?

When you say that you're "finalising" your trust deed could you confirm exactly where you're up to at this stage?

Hi Howies08

If you've not yet signed the Trust Deed, then yes the creditor is still able to proceed with action. You need to remember that finalised legal action before the date of signing the Trust Deed is NOT cut down.

What have you been served with?

hi mark, i've actually just sent paperwork through for assessment for yourself this morning. Not able to phone and speak to Maria as i'm working all day. I'm slyly on internet on my phone at work! I received a message at arms or somethin to that description from a local sheriff officer from one of my creditors regarding payment of debt owed to them! Wondered what further action they could take.

Hi Howie08

It really depends what you've been served with.

If its the initial stages of a court action, then you have time on your side to have the Trust Deed in place before the final hearing date and stop anything happening. If it is a wage/bank arrestment, then this is slightly more difficult.

it was just a message at arms letter, giving me 14 days to pay the amount before any more "diligence" or somethin like that, not an arrestment of wages or court action. But does warn that could happen in the future. I've sent paper's through with other documents for yourself. You should receive them tomorrow! Worryin time being close to trust deed but more worryin when i got this notice.

If it's at the threat stage, I suspect you have got a good bit of time left, so dont worry too much.

The 14-day period sounds suspiciously like it could be a charge for payment, in which case it might be a bit of a race against time to get everything set up and protected.
