Sequestration while in Trust Deed

Scott and Co have said they will sequestrate me unless I pay the full amount due to them (which is not included in my Trust Deed) while I still have a current secure Trust Deed for other debts. Can they do this?

Hi Eveyb

I assume they mean that the Council will petition for sequestration if the debt remains unpaid.

If this was incurred after the trust deed was signed and they are a qualifying creditor, then they can petition for sequestration. This will take over from the trust deed.

When do the council tax arrears relate to, Eveyb? Before or after the trust deed was signed?
