Hi just wondered if you people in the know could answer a couple of questions if I was thinking of going down the sequestration route:

1. Will i lose my car?
2. will my name appear in the paper again?

Are you still in the trust deed?

Could you tell us how much your car is worth and what purposes it is used for?

When you say about your name being in the paper, do you mean the Edinburgh Gazette?

I've missed two payments.

Car worth about ยฃ6500 - communting to and from work for both my partner and myself.

Is there a particular reason that you have got behind on the payments?

Have you been told you will be discharged from the trust deed with your debts still in place?

A car valued over ยฃ3000 may well be at risk in sequestration. It is the case that a public record of a sequestration will be made (as with a trust deed).

Variety of reasons - moving house and changing banks and not knowning the payments hadn't gone out until I received my statement yesterday!

To clarify, your name probably will not be in the Edinburgh Gazette as there is no longer any requirement for sequestrations to be advertised there, only protected trust deeds. However, your details will be placed on the Register of Insolvencies, which is a matter of public record and can easily be accessed online.

Has your trust deed been terminated already? If not it may be worth speaking to your trustee again - 2 missed payments is hardly a hanging offence, I'd have thought that they would allow you to catch that up in future.

Hi Kevin

I know that details of sequestrations are placed on the Register of Insolvencies, are details of PTD's also placed here? Or are there any other public records of PTD's?

The AiB website has a list of trust deeds and sequestrations,which is accessable to all.
