Hi,
Apologies if this question has been posted, I did have a look.
I was discharged from my TD in April 2014 having paid the pre-arranged amount over the agreed period and my Trustee discharged himself in December 2014.
In the past few months I have received an annual statement from Max Recovery (outlining money still outstanding on the account with them) & I have also noticed a new entry on my credit file today from "Pco Holdco S.a.r.l3" (assume a debt was sold on to them as I don't recognise this name) show an account in default dated 2010.
I have two questions.
1) If the TD is 100% satisfied and both I and the Trustee are discharged, should I continue to get any statements etc on monies that were owned? Can I write to the company asking them to stop?
2) Can a 3rd party update my credit file like this, for a debit that was covered in the TD? Can I ask them to remove this entry?
Appreciate any guidance.
Regards, James
Hi. I just came on here to ask the same thing. Just checked my credit file which has been steadily going up for the past year since TD finished. Now these PCO SARL HOLDCO clowns have reopened their account and it is showing 16000 in default and my credit score has nosedived

If this was a debt that existed prior to the signing of the Trust Deed then your liability for it is discharged. You should contact them to point out their error and request that they remove the entry from your credit file.
Hi Kevin. Problem with that is they are not exactly Bank of Scotland or whatever, they don't appear easily contactable from my searches. Obviously something going on if it isn't just mine that has reappeared out of nowhere.

Thanks I will give it a try. Pretty annoying set back after a year of progress.

it may be worth going to the original lender. Looking at the information from the ICO the original creditor may still be responsible for making sure that the information is accurate. Page 3 of this link

Make sure you make your requests in writing and that way you can use the response if you need to make a complain to the ICO
Hi Steve
I had the same issue with a couple of companies who had bought the debt.
The original company is responsible if it was included in your Trust Deed. The company who buys takes a (calculated) chance when they buy the debt that some will be loss-making.
I wrote to the (second) companies, sent a copy of the Trust Deed document and referred them to my Trustee with name and address. Asked them to remove the record on the creditor file.
That worked for me.
Good luck.
