Well most of you know my story so wont blabber on again with all details. But i do have an update. [:)]
I got letter back from KPMG This morning after sending them a second recorded delivery letter and there has been a whole 360 turn on there part in regards to some of the information. But slightly trying to turn it back in there favour.
They are saying now i cant be discharged BUT...... if i dont make a payment as of the 1st of march the trustee with discharge himself and list it as non complience for payment on my part and inform my creditors that i am no longer in a PTD in which they can then persue me as before and take action again me. He then asked me again to rethink about continuing with making payments to avoid this. I think the whole creditors coming after me was meant to scare me but i knew that would be coming if i did get out of it so i didnt even batter an eyelid.
In the last letter i put in all the legal notes i could find in regards to contributions from benefits in regards to trust deeds and how they must be alienable and can not be accepts by a trustee. He says in the letter that contributions can be sought from benefits and that the legistlation of benefits being alienable only holds under the sequestration act (legislation soley) and not the trust deed. Yet when i checked the AIB Website i found a document with the same information in this relating to trust deeds as well as sequrestration so i think he needs to update his information on that point. I also double checked my information that i put in the letter on law websites and still came to the same conclusion benefits can not and will not be sought for the benefit of a trustee under any circumstance. Even found one where it says even if i knew of this knowledge and paid them they have to pay me that money back. I put that in last letter too, but he says i will not get any of my money back as it has already been used to cover the costs of the work done on my case. He then states i should reconsider my situation to continue payments again.
In my last letter i stated about two phone conversations i had with them in nov/dec in regards to rising payments in gas and electricty. He states after looking into this matter his office has no record of these calls and does not feel this will effect my ability to continue to pay contributions to my trust deed. Yet at start of letter he said he was discharging himself.[?][?][?]
On the matter of payplan referring me to KPMG, he again did not provide me with the information i have requested twice now. he seems to be avoiding giving me an explination as what work was carried out and a small paragraph was printed before moving back onto the subject at hand about me reconsidering starting payments again.

It's great to hear that you're now in a position to do what you want to do; exit the trust deed and proceed with sequestration. Congratulations to you on your determination to make this happen.
Some credit to KPMG as well for taking the steps to make this possible for you. The letter may not read as being very friendly, but I can understand from their perspective why it has been written in the terms that you describe.
Hopefully the future looks a lot more positive for you now?
There is a little more information we'd like to share in connection to this situation.
One of the Trust-Deed.co.uk advice team knows a senior employee at Payplan. With Reidy1982's permission we contacted them and asked that they have a look into the situation.
They were very concerned to hear about Reidy1982's issue and immediately volunteered to look into the matter from their end.
We've heard from Payplan that conversations with KPMG have recently been held with a view to bringing the matter to a satisfactory conclusion for all involved. I think both organisations deserve some credit.

Yes trust deed assistant now i know there is a light at the end of the tunnel its one less thing to think about regarding the whole mess. As i will have a lot more on my plate as of start of march as my mother is being taken in for an operation and her health isn't that good allready, so there slight risk of complications which doctors informed my mother and myself and family just today.
Thank you for the update in regards to the other subject i wasn't sure what was happening there. I just knew there was contact with payplan but nothing there after.
We weren't really in a position to say anything Lou as they obviously wanted to take a little time to review everything and discuss matters with the other firm. It's kind of been rumbling along in the background but they did take time out to get in touch with us and bring us up to date today (not long after you started this thread by coincidence).
I've said this before, but I think you have been incredibly dignified in the way you have written about this here, and also in the way that you have gone about dealing with the situation.
I also think that Mark Mcfadyen has been absolutely incredible in offering his time, support and knowledge to you and therefore playing a massive role in helping you to move forwards.
Going back a little while ago I think a lot of people were really genuinely concerned when you first started writing on the forum. I cannot remember a thread on the forum ever where so many people wanted to help in whatever way that they could.
It's really really great that the efforts of a lot of people in many different places (not least your own efforts) seem to have resulted in an appropriate outcome in the end.
It's a shame to hear about your mother. Hopefully you'll now have one less big worry on your mind as you go about supporting her next month though.

Thank you TDA For that information, i'm glad to hear they have kept you updated, KPMG did take a while to get back to me this time round so that maybe explains there delays if there has been meetings to discuss things.
Thank you for your kind comments, this whole experiences has made me more determined to find a way to help other like myself who are benefit based not end up in a situation like this. I just am not sure how to go about it at this time.
Mark has been an amazing and outstanding help through the whole process. He's been so kind and gone out of his way to help me and it is something i will never forget.
I thank everyone for all the advice i have recieved so far since i joined the forum. This community is such a caring and lovley community and it's so far been pleasure of dealing with everyone here and reading everyones different situation. I have learnt a lot from Trustdeed.co.uk.
